BEING A BY-LAW TO AMEND ZONING BY-LAWI84-3, BEING THE COMPREHENSIVE ZONING BY-LAW FOR 1)iE FORMER VILLAGE OF TIVERTON . MUNICIPALITY OF KINCARDINE C/O CATHERINE MCKAGIjIE, PART LOT 1, CONCESSION 1, (BEING PART 1, REFERENCE PLAN 3R-3504¡MUNICIPALITY OF KINCARDINE [FORMER TOWNSHIP OF BRUCE] AND PAR OF PLAN M-50 MUNICIPALITY OF KINCARDINE [FORMER VILLAGE 0 . TIVERTON» WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt~r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws \\ hich comply with an approved official plan; I , , , AND WHEREAS the Council of the Corporation of the Village of tiverton has enacted By-law 84-3, a zoning by-law enacted under Section 34 of the said ~Ianning Act; AND WHEREAS the Corporation of the Village of Tiverton has restructured to now be a part of the Corporation of the Municipality of Kincardine; I I AND WHEREAS the Corporation of the Municipality of Kincardine ~esires to amend By- law 84-3; . I , I NOW THEREFORE the Council of the Corporation of the Munifipality of Kincardine ENACTS as follows: I I ! 1. Schedule 'A' to By-law No. 84-3 as amended, is herebY~mended by deleting those lands described as Part of Plan M-50 Municipality f Kincardine (former Village of Tiverton), from the Schedule as outlined on t e attached Schedule 'A' forming a part of this by-law. I , , 2. Schedule 'A' to By-law No. 84-3 as amended, is ~ereby amended by incorporating those lands described as Part Lot 1, Con$ssion 1, (being Part 1, Reference Plan 3R-3504), Municipality of Kincardine I {former Township of Bruce), within the Village boundary, as outlined on Schequle 'A' forming a part of this by-law. Schedule 'A' to By-law No. 84-3 as amended, is hereb~· further amended by zoning those lands described as Part Lot 1, Concessi n 1, (being Part 1, Reference Plan 3R-3504), Municipality of Kincardine former Township of Bruce), as 'I-b-H - Institutional Special Holding' as out! ned on Schedule 'A' forming a part of this by-law. ! Page 2 of 3 18.3{b) Notwithstanding the 'I' zoning designation, thos, lands delineated as 'I-b-H' on Schedule 'A' to this by-law may be! used in accordance with permitted uses of the' ' zone, excepting hQlNever that the following provisions shall apply: Provisions Municipal Water & Sewer Minimum Lot Area 550 square metres Minimum Lot Frontage 15 metres Minimum Lot Frontage - comer lot 18 metres , Minimum Exterior Side Yard 5.9 metres Minimum Front Yard 7.5 metres · Minimum Rear Yard 10 metres · Minimum Side Yard 2 metres I Minimum ground floor area 70 square metres Maximum Building Height - principal 10 metres · building , Maximum Lot Coverage 40% Minimum No. of Parking Spaces 1 space of every 3 !beds or fraction thereof , Parking Space LengthlWidth 2.9 metres in width: and 6 metres in length except for t~ose parking spaces along the north proþerty line which may be reduced to 5 m~tres in length. Parking Area Location on Lot Permitted in all yartls provided that no part of any parking I area, other than a driveway, is locate~ closer than 1.0 metre to any street! line and no closer than 1.0 metre from any other property line. Handicapped Parking Spaces A minimum of 2 H~ndicapped spaces shall be provided. The minimum width shall be 4 metres. Where two or more spaces are located! together the space may be reduced tol3 metres. Loading Spaces Requirements One loading spacel shall be provided in accordance with S~ction 6.16 excepting howeve~ that the Access driveway [Section ~.16.2] may be reduced to 5 metres in width. All other provisions of By-law 84-3 shall apply where appUcable. 5. That the 'H - Holding' provision on lands to be zoned I'I-b-H' shall only be removed once the following conditions have been met: . This By-law takes effect from the date of passage by COlilncil and comes into force and effect pursuant to the provisions of the Plannir¡¡g Act, RS.O. 1990 and subject to the site specific official plan amendment fpr the subject lands being in force and effect pursuant to the provisions of the Planning Act, RS.O. 1990 7. This By-law may be cited as the "Amendment to Compr~hensive Zoning By- law 84-3, (Part Lot 1, Concession 1, [being Part 1, Refer$nce Plan 3R-3504], [former Township of Bruce] and Part of Plan M-50 [forme~ Village of Tiverton], Municipality of Kincardine, Ward 3), By-Law. Read a FIRST, SECOND and a THIRD time and DEEMED TO BE FlASSED this 7th day of May 2003. .... ."'.
