BEING A BY-LAW TO AMEND ZONING BY-LAW 2~03-25,
BEING THE COMPREHENSIVE ZONING BY-LAW FþR THE
MUNICIPALITY OF KINCARDINE .

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt~r 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws Y.hich comply with an
approved official plan; I
AND WHEREAS the Council of the Corporation of the MuniciPa~ty of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Section 3 of the said Planning
Act·

AND WHEREAS the Corporation of the Municipality of Kincardine ~esires to amend By-
law 2003-25; I

NOW THEREFORE the Council of the Corporation of the Munifipality of Kincardine
ENACTS as follows: I

1. Schedule 'A' to By-law No. 2003-25 as amended, bein I the Comprehensive
Zoning By-Law for the Municipality of Kincardine is he by further amended
by zoning those lands described as Part Lot 1, Conces ion 1, (being Part 1,
Reference Plan 3R-3504), Municipality of Kincardine former Township of
Bruce), as 'I-b-H - Institutional Special Holding' as outl ned on Schedule 'A'
forming a part of this by-law. I

Schedule 'A' to By-law No. 2003-25 as amended, bein the Comprehensive
Zoning By-Law for the Municipality of Kincardine is he by further amended
by zoning those lands described as Part of Plan -50 Municipality of
Kincardine (former Village of Tiverton), as 'A2 - Restr cted Agriculture' and
'EP- Environmental Protection' as outlined on Schedule 'A' forming a part of
this by-law.

By-Law No. 2003-25, as amended, being the Compreh~nsive Zoning By-Law
for the Municipality of Kincardine, is hereby further am~nded by adding the
following paragraph to Section 31.4 Special Provisions: !

Notwithstanding the'' zoning designation, thosd lands delineated as
'I-b-H' on Schedule 'A' to this By-law may be us~ in accordance with
permitted uses and zone provisions of the 'I' z01e contained,
excepting however that: i
(i) The minimum exterior side yard setback shall be no less than 5.9
metres (19.34 feet);

(ii) Notwithstanding the Definition of 'parking sll>ace', the minimum
parking space length for those parking space$ only located along
the north property line may be reduced to no, less than 5 metres
(16.4 feet); and
(iii) Notwithstanding 'Section 6.20.7 Parking Area ~ocation on Lot', the
parking area along the north property line shall be setback from
property line no less than 1.0 metre (3.28 feet);.
(iv) A 'Loading Space' in accordance with Se¢tion 6.18 shall be
provided, excepting however that the drive'l(ay access may be
reduced to 5 metres in width (16.4 feet).
That the 'H - Holding' provision on lands to be zoned ,'I-b-H' shall only be
removed once the following conditions have been met:
(a) A 'Site Plan Agreement' as per Section 41(7)(c) ha$ been registered as
per Section 41(10) ofthe Planning Act RSO 1990 as ~mended.
5. This By-law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planninq Act, R.S.O. 1990
and subject to the site specific official plan amendment for the subject lands
being in force and effect pursuant to the provisions of the IPlanning Act,
R.S.O. 1990.
6. This By-law' may be cited as the· Amendment to Compretl1ensive Zoning By-
law 2003-25, (Part Lot 1, Concession 1, [being Part 1, Re~erence Plan 3R-
3504], [former Township of Bruce] and Part of Plan M-50 I[former Village of
Tiverton], Municipality of Kincardine, Ward 3)", By-Law.
Read a FIRST, SECOND and a THIRD time and DEEMED TO BE pASSED
this 7th day of May 2003. .
