Home My WebLink About05 197 Consolidated solid waste e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE ~8T BY-LAW NO. 2005 -197 BEING A BY-LAW TO SET RATES AND FEES FOR SOLID WASTE MANGEMENT, SANITARY AND WATER CAPITAL CHARGES AND SANITARY SEWER AND WATER OPERATING CHARGES FOR THE MUNICIPALITY OF KINCARDINE WHEREAS Section 391 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes municipalities to pass by-laws imposing fees or charges on any class of persons for services or activities provided or done by it or on behalf of it; AND WHEREAS Section 12 (2) of O.Reg. 244/02, provides that the amount of fees or charges for the use of a waste management system, the use of a sewage system or the consumption of water shall not exceed the cost of providing the waste management system, sewage or water system; AND WHEREAS Section 12 (3) of O.Reg. 244/02 provides that a by-law for the setting of fees for the use of a waste management system, a sewage system or the consumption of water, if not repealed earlier, expires on December 31 of the year following the year in which the by-law was passed. AND WHEREAS the Council for the Corporation of the Municipality of Kincardine deems it expedient to pass a by-law to set fees for solid waste management, sanitary sewer and water capital, and sanitary sewer and water operating charges; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the rates and fees for Solid Waste Management, as described in the attached Schedule "A"", be hereby set. 2. That the rates and fees for Sanitary Sewer Capital Charges, as described in the attached Schedule "B", be hereby set. 3. That the rates and fees for Water Capital Charges, as described in the attached Schedule "C", be hereby set. 4. That the rates and fees for Sanitary Sewer Operating Charges, as described in the attached Schedule "D", be hereby set. 5. That this by-law shall supercede any previous by-law inconsistent with the provisions contained herein. 7. That this by-law shall come into full force and effect as of January 1, 2006. 8. That this By-Law shall be known as the "2006 Consolidated Solid Waste Management, Sanitary Sewer and Water Rates and Fees By-law".
