HomeMy WebLinkAbout05 198 Underwood Drinking water e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2005 -198 BEING A BY-LAW TO APPROVE THE FRAGMENTATION OF PART OF THE MUNICIPAL DRINKING WATER SYSTEM SERVING THE COMMUNITY OF UNDERWOOD IN THE MUNICIPALITY OF KINCARDINE WHEREAS the Corporation of the Township of Bruce passed By-law # 75-18 on the 16th day of September, 1975 to authorize the construction of a water supply and distribution works in the Hamlet of Underwood, and to provide for the imposing upon the owners or occupants of lands who derive a benefit from the said works, sufficient to pay the capital cost of the said works, and for an annual service charge against all properties connected to the water main; AND WHEREAS By-law No. 2002-181, as amended, was passed by the Municipality of Kincardine on December 18, 2002 to establish rates and fees for the services performed by the Municipality; AND WHEREAS pursuant to the Safe Drinking Water Act, 2002, 5.0. 2002, c.32, and the regulations made thereunder and subject to the limitations thereof, the Ministry of Environment issued an approval (Certificate of Approval Municipal Drinking Water Systems Number 4843-6GTQ33) under Part V of the Safe Drinking Water Act, 2002, S.O. 2002, c.32 to the Corporation of the Municipality of Kincardine for fragmenting part of the municipal drinking-water system serving the community of Underwood for one (1) residence, currently owned by Ms. Mary Jean Large, located at 3625 Highway 21, R.R.#3, Tiverton, (NAD83: UTM Zone 17: 461258 mE., 4905954 m N.) disconnected from the municipal drinking-water system and connected to a private well on her property, equipped with disinfection system meeting with the approval of the Public Health Grey-Bruce Health Unit; AND WHEREAS the Public Health Grey-Bruce Heath Unit has no objection to the fragmentation provided the quality of water obtained from the private source is at least equal to the current waster quality obtained from the municipal supply with a request that an approved Ultra Violet light system be installed and maintained by the property owners as a means of disinfection; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: . . ./2 e e e e Page 2 Fragmentation of Part of the Underwood Drinking Water By-law By-law No. 2005 - 198 1. That fragmenting part of the municipal drinking-water system serving the community of Underwood, located in the Municipality of Kincardine is approved as follows: one (1) residence, currently owned by Ms. Mary Jean Large, located at 3625 Highway 21, R.R.#3, Tiverton, (NAD83: UTM Zone 17: 461258 mE., 4905954 m N.) disconnected from the municipal drinking-water system and connected to a private well on her property, equipped with disinfection system meeting with the approval of the Public Health Grey-Bruce Health Unit; 2. That the aforesaid property be exempted from operating charges established under By-law # 75-18 (former Bruce) and By-law No. 2002-181, as amended. 3. That operating charges from May 01, 2004 be refunded to the property owners of the aforesaid property. 4. That this by-Iawshall supercede any previous by-law inconsistent with the provisions contained herein. 5. That this by-law shall come into full force and effect upon its final passage. 6. That this By-Law shall be known as the "Fragmentation of Part of the Underwood Drinking Water By-law". READ a FIRST, SECOND and THIRD TIME and FINALLY PASSED this 21st day of December 2005.
