THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2005 - 189
BEING A BY-LAW TO ACCEPT A QUOTE FOR REPAIRS TO THE TIVERTON
WATER TOWER
(Landmark Tank & Tower Services)
WHEREAS the Province of Ontario has enacted the Safe Drinking Water Act,
2002, O.Reg. 170/03, amended to O.Reg. 253/05, to protect human health
through the control and regulation of drinking-water systems and drinking-water
testing;
AND WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 Section 11 (2)
authorizes municipalities to pass by-laws respecting matters within the sphere of
jurisdiction of water distribution;
AND WHEREAS the said Municipal Act, Sections 8 and 9 (1) provides
municipalities with powers of a natural person to enable them to govern their
affairs as they consider appropriate and to enhance their ability to respond to
municipal issues;
AND WHEREAS it has been determined that repairs to the Tiverton Water Tower
are required to ensure compliance with Ministry of Labour regulatory codes and
the prevention of structural damage;
AND WHEREAS the Council for the Corporation of the Municipality of Kincardine
deems it necessary to accept a quotation from Landmark Tank and Tower
Services for the supply and installation of fall arrest upgrades, roof guard rail kick
plates and lighting protection upgrades at the Tiverton Water Tower;
. NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the quotation of Landmark Tank and Tower Services of Burlington,
Ontario for the supply and installation of fall arrest upgrades, roof guard rail
kick plates and lightning protection upgrades, in the amount of $20,660.00,
excluding taxes, be hereby accepted.
2. That the Mayor and CAO be hereby authorized to sign, on behalf of the
Council for The Corporation of the Municipality of Kincardine any contracts
and other documents required to authorize such work to commence.
3. That the awarding of the quote for the repairs to the Tiverton Water Tower
be exempted from the Municipality of Kincardine purchasing and
procurement policy GG.2.17.
4.
This by-law shall come into full force and effect upon its final passage.
