By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT 01Y0FK1NGP���� BY-LAW No. 2023 -193 Being a By-law to Amend Zoning By-law No. 2003-25, being the Comprehensive Zoning By-law for the Municipality of Kincardine Business and Innovation Centre Inc. 22 Farrell Drive- PLAN 3M-113 LOT 12 3R-3861; PART 10, Kincardine 50 Farrell Drive- PLAN 3M-113 LOT 13 3R-3861; PART 9, Kincardine 64 Farrell Drive- PLAN 3M-113 LOT 14 3R-3861; PART 7, Kincardine 131 Farrell Drive - PLAN 3M-113 LOT 2, Kincardine Whereas Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; and Whereas the Council of The Corporation of the Municipality of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Section 34 of the said Planning Act; and Whereas Council passed By-law 2022- 164 on November 14, 2022 which amended By-law No. 2003-25 to include a Holding (h) Provision on certain lands; and Whereas all the conditions of the Holding (h) Provision have been satisfied; and Whereas the Council of The Corporation of the Municipality of Kincardine desires to amend By-law 2003-25; now therefore be it Resolved that the Council of The Corporation of the Municipality of Kincardine Enacts as follows: 1. Schedule 'A'to By-law No. 2003-25 as amended, is hereby further amended by changing the zoning from "EC12-a-h"to "EC12-a"the zoning designation of those lands outlined on the attached Schedule `A' 2. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 3. This By-law may be cited as the "Amendment to Zoning By-law No. 2003- 25, Holding Removal (Business and Innovation Centre Inc.) By-law". Read a First and Second Time this 22"d day of November,2023. Read a Third Time and Finally Passed this 22"d day of November, 2023.
