BY-LAW
NO. 2004 - 121
BEING A BV-LAW TO CONFIRM THE ACQUISITION OF LAND FOR
HIGHWA V WIDENING PURPOSES AND ESTABLISHING HE SAME AS
PART OF THE PUBLIC HIGHWAV SYSTEM FOR THE MU ICIPALlTY OF
KINCARDINE
WHEREAS Section 31 (1) of The Municipal Act, 2001, S.O 2001, c. 25, as
amended, authorizes municipalities to pass by-laws to establish a highway;
AND WHEREAS pursuant to the said Municipal Act, Section 31 (6) that land
acquired for the purpose of widening a highway forms part of t e highway to the
extent of the designated widening;
AND WHEREAS The Corporation of the Municipality of Kin rdine previously
acquired land for the purpose of widening and improving the existing highway
system of the Municipality of Kincardine;
AND WHEREAS it is desirous to confirm the acquisition of the I nd as part of the
public highway system of the Municipality of Kincardine;
NOW THEREFORE the Council for The Corporation of t e Municipality of
Kincardine ENACTS as follows:
1. That the acquisition of the lands described in the schedu e attached to this
by-law is hereby confirmed and approved.
2.
That the said lands described in Schedule "A" attached to this by-law are
hereby acquired for highway widening purposes and re accepted and
dedicated as part of the public highway system of t e Municipality of
Kincardine.
3. That this by-law shall become effective upon its fina passage by the
Council of the Municipality of Kincardine and upon its egistration in the
Registry Office for the Registry division of Bruce (No.3).
4.
This by-law may be cited as the "Highway Dedication ( lock E Plan 3M-
99) By-law".
