Home My WebLink About04 129 road closure steelback e e e e THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2004 - 129 I I BEING A BY-LAW TO TEMPORARILY CLOSE STREETS TolFACILlTATE A STEELBACK BREWERY/KINCARDINE LABOUR DAYWEEK~ND MUSIC FEST WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, Section 8 and 9 provide municipalities with powers of a natural person to enable them to g vem their affairs as they consider appropriate and to enhance their ability to respond to unicipal issues; AND WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, Sectio 11 (2) provides that lower-tier municipalities may pass by-laws within the sphere of juri diction of highways, including parking and traffic on highways; AND WHEREAS the Council for the Municipality of Kincardine ha given its support to the draft ·Steelback Labour Day Weekend Music Fest" event, ubject to site plan approval; AND WHEREAS Steelback Brewery wishes to close a portion of Queen Street to restrict unauthorized traffic on Saturday, September 4, 2004, Su day, September 5, 2004 and Monday, September 6, 2004 from 11 :00 a.m. to 4:00 p. . in order to hold the Steel back Brewery/Kincardine Labour Day Weekend Music Fest Ev nt; i AND WHEREAS Steelback Brewery also wishes to close certa n streets to restrict unauthorized traffic on Saturday, September 4, 2004, Sunday, Se tember 5, 2004 and Monday, September 6, 2004 from 4:00 p.m. to 11 :00 p.m. in order t hold the Steelback Brewery/Kincardine Labour Day Weekend Music Fest Event; NOW THEREFORE the Council for The Corporation of the Muni ipality of Kincardine ENACTS as follows: 1. That part of Queen Street, northerly from Durham Mark t North to Durham Street, be closed to all vehicular traffic, other than those v hicles authorized by the organizers, on Saturday, September 4, 2004, Sunday, September 5, 2004 and Monday, September 6,2004 from 12:00 noon to 4:00 p. . for the purpose of holding the Steelback Brewery/Kincardine Labour Day eekend Music Fest Event as per the attached Schedule "A"; 2. That part of Penetangore Row southerly from Bruce Aven e to Saratoga Ro¡¡d be closed to all vehicular traffic, other than those vehicl s authorized by the organizers, on Saturday, September 4, 2004, Sunday, Se tember 5, 2004 and Monday, September 6, 2004 from 4:00 p.m. to 11 :00 p.m. for the purpose of holding the Steelback Brewery/Kincardine Labour Day eekend Music Fest Event as per the attached Schedule ·B"; . . ./2 ,'{ e e e . Steelback Brewery Labour Day Weekend Music Fest y-Law By-law No. 2004 - 129 Page 2 , That part of Bruce Avenue easterly from Penetangore Row Ito Queen Street be closed to all vehicular traffic, other than those vehiclesi authorized by the organizers, on Saturday, September 4, 2004, Sunday, Sep~ember 5, 2004 and Monday, September 6, 2004 from 4:00 p.m. to 11 :00 p.m~ for the purpose of holding the Steelback Brewery/Kincardine Labour Day Wþekend Music Fest Event as per the attached Schedule "B"; ¡ That part of Saratoga Road from Penetangore Row easterl~ to Highway 21 be closed to all vehicular traffic, other than thoSe vehicles I authorized by the organizers on Saturday, September 4, 2004, Sunday, Sep.ember 5, 2004 and Monday, September 6, 2004 from 4:00 p.m. to 11 :00 p.mi for the purpose of holding the Steel back Brewery/Kincardine Labour Day W~ekend Music Fest Event as per the attached Schedule "B"; . i i Steel back Brewery shall erect at each end of such highway or portion thereof, and where an altemative route deviates therefore, a barriqade upon which an adequate warning device shall be exposed and in gþod working order continuously from sunset until sunrise and at such points thete shall be erected a detour sign indicating the alternative route and containin$J a notice that the highway is closed to traffic. 3. 4. 5. ¡ 6. Every person who uses a highway or portion of a highwa~ so closed to traffic does so at his or her own risk and The Corporation ofl the Municipality of Kincardine is not liable for any damage sustained by a persqn using the highway or portion thereof so closed to traffic. 7. Every person who without lawful authority uses a highway <l>r portion thereof so closed to traffic while it is protected in accordance with thi~ paragraph, or who removes or defaces any barricade, device, detour sign or n¢>tice placed thereon by lawful authority, is guilty of an offence and is subject to Ithe penalties as set forth in the Provincial Offences Act and is also liable to Thø Corporation of the Municipality of Kincardine for any damage or injury occasionþd by such wrongful use, removal or defacement. This by law shall come into full force and effect upon its final þassage. This by-law may be cited as the "Steel back Brewery Labour þay Weekend Music Fest Road Closing (2004) By-law". 8. 9.
