BEING A BY-LAW TO AUTHORIZE THE SIGNING OF AN A~REEMENT TO
EXTEND THE PAVING OF ROADS IN THE KINCARDIN WATER
TREATMENT PLANT EXPANDED SERVICE AREA FOR THE MUNICIPALITY
OF KINCARDINE I

WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 Section 111 (2) authorizes
municipalities to pass by-laws respecting matters within the sphfre of jurisdiction
of water distribution; I
AND WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 Se tions 8 and 9 (1)
provides municipalities with powers of a natural person to enab e them to govem
their affairs as they consider appropriate under this or any other ct;
AND WHEREAS the Province of Ontario has enacted the Sa Drinking Water
Act, 2002, as amended, to protect human health through the control and
regulation of drinking-water systems and drinking-water testing;
AND WHEREAS the Council for The Corporation of the MuniciP~lity of Kin.cardine
has deemed it necessary to construct a shoreline water dist bution system to
meet regulations in the Safe Drinking Water Act, 2002, as amen ed;
AND WHEREAS the Council for The Corporation of the Municip lity of Kincardine
accepted a tender from Omega Contractors Inc. with the pas ge of By-law No.
2003 - 128 to construct a shoreline water distribution syst m including the
restoration of those portions of roads excavated in order to instal water mains;
AND WHEREAS The Council for The Corporation of th
Kincardine deems it expedient to accept an extension to the
Contractors Inc., authorized by By-law No. 2003 - 128, in
asphalt restoration to the full road width for those roads
excavated to construct the shoreline water distribution system;

system in the Kincardine Water Treatment Plant Expan ed Service Area
(Contracts 1 & 2) be exempted from the Municipal ty of Kincardine
tendering policy GG.2.4.

Paving Extension Contract - Kincardine Water Treatmert Plant
Expanded Service Area .
That the proposal submitted by Omega Contractors Inc. of london, Ontario
in the amount of $202,902.30 plus all applicable taxes for ~he completion of
asphalt restoration to the full road width for those ro~ds excavated to
construct the shoreline water distribution system (Cont~acts 1 & 2) and
consisting of, but not limited to, the removal, supply and i placing of gravel
and asphalt be hereby accepted as outlined in Schedul~ "A" attached to
this by-law.

3. That the Mayor and CAO be hereby authorized to sign,¡ on behalf of the
Council for The Corporation of the Municipality of Kincarqine any contracts
and other documents required to authorize such work to cþmmence.
4. That the Mayor and CAO be hereby authorized to ma~e such technical
changes to the construction contract documents as might be required to
commence and complete the contract provided that such þhanges do not in
any way make any material changes to the intent of the work as referred to
in paragraph 2 of this by-law. .
5.
This by-law shall come into full force and effect upon its firal passage.
This by-law may be cited as the "Omega Paving Extelnsion (Kincardine
Water Treatment Plant Expanded Service Area C~ntracts 1 & 2)
Acceptance By-law". .
6.
READ a FIRST, SECOND, and THIRD time and DEEMED TOI BE PASSED this
7th day of July, 2004.
