BEING A BY-LAW TO AMEND ZONING BY·LAW N .2003-25,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE
MUNICIPALITY OF KINCARDINE

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt1'r 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws w ich comply with an
approved official plan; !
AND WHEREAS the Council of the Corporation of the Municipali of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Sec on 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Munici ality of Kincardine
desires to amend By-law 2003-25;

NOW THEREFORE the Council of the Corporation of the Muniqpality of Kincardine
ENACTS as follows: I

Schedule 'A' to By-law 2003-25 as amended, is hereby urther amended by
changing thereon from 'C2' to 'C2-g' the zoning design tion of those lands
described as Part of Park Lot 16 on Plan 4, (being Parts 1 and 2 on RP 3R-
3564), Municipality of Kincardine (former Town of Kincardin ), which are outlined
on the attached Schedule 'A'.

2. Notwithstanding their 'C2' zoning designation, those lands escribed as Part of
Park Lot 16 on Plan 4, (being Parts 1 and 2 on RP 3R-3 64), Municipality of
Kincardine (former Town of Kincardine) and delineated as' 2-g' on Schedule 'A'
to this By-law shall be used in accordance with the 'C2' zon excepting, however,
that:

The permitted non-residential uses shall in lude a 'Contractor's
Yard';
The minimum east side yard setback shall be 1 .2 m;
The maximum building height shall be 5.2 m;
All open storage shall be in accordance ith Section 25.4.1
(Additional Provisions - General Industrial Op n Storage);
The minimum lot frontage shall be 20.1 m;
A Planting Strip shall be provided along the ront lot line with the
exception of areas reserved for the drivewa , in addition to the
provisions of Section 6.21 (Planting StripslPriv cy Fence);
The lands shall be subject to Site Plan Control

This By-law takes effect from the date of passage by Courlcil and comes into
force and effect pursuant to the provisions ofthe Planning Act~ R.S.O. 1990.

This By-law may be cited as the "Amendment to Comprehensive Zoning By-law
2003-25, (Part of Park Lot 16 on Plan 4, (being Parts 1 and!2 on RP 3R-3564),
Municipality of Kincardine (former Town of Kincardine», By-L*w".
READ a FIRST, SECOND and THIRD TIME and FINALLY PAS$ED this 7111 day of
July 2004.
