THE CORPORATION OF THE MUNICIPALITY OF KINC INE
NO. 2004 - 102
A BY-LAW TO ACCEPT A TENDER FOR THE PAVI G OF
VARIOUS LOCATIONS WITHIN THE MUNICIPALITY OF KIN ARDINE
(HAROLD SUTHERLAND CONSTRUCTION)
WHEREAS the Municipal Act, 2001, S.. 2001,c.25 Sections 8 a d 9 (1) provides
municipalities with powers of a natural person to enable the to govem their
affairs as they consider appropriate under this or any other Act and to enhance
their ability to respond to municipal issues;
AND WHEREAS the Council for The Corporation of the Municipa ity of Kincardine
deems it expedient to accept a tender to complete the paving of arious locations
throughout the Municipality of Kincardine;
AND WHEREAS Council has approved a Capital Budget of 620,000.00 for
paving various locations within the Municipality;
AND WHEREAS the actual impact to the Public Works budg t for paving of
various locations is $649,442.00 net of G.S.T., being $29,442.00 in excess of the
budget;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1.
That the tender of Harold Sutherland Construction in the amount of
$694,902.94 inclusive of all applicable taxes, be hereby ac epted.
That the Mayor and CAD be hereby authorized to sign, n behalf of the
Council for The Corporation of the Municipality of Ki cardine, any
contracts and other documents required to authorize such work to
commence, and to affix the corporate seal of The Municipality of
Kincardine.

3. This by-law shall come into full force and effect upon its fin I passage.
4. This by-law may be cited as the ·Sutherland Paving Ten er Acceptance,
By-law".
