CclBPositlon.
1. A municipal fire department is hereq,y established
under the :ithority qf the Municipal Act tô be known as

2. The department shall consist of a ehiê!, a

4. - (1) The Oh_ef shall be appointed by by-law
passed by the council and shall hold office until such
by-law is rescinded.
(2) All ·officers and fire fighters shall be
appointed by the council upon the recommendation of the

5. The chief may suspend any officer or fire fighter

repeated failure to attend practices or. fires; the chief
shall refer such suspension to the council; together with
his report and recOlDlllendations, for such a.<!tion ae it may
deEl11 advisable.
6. The annual cost of operating the department shall be
included in the annual estimates of the municipalitT and the
clerk shall so notify the chief at least two weeks prior to
the date on which the municipal estimates are to be considered;
and the chief shall submit within one week,thereafter his
estimates for the expenditures necessary d'l1'~ the forthcondng
year fer the operation and maintenance of 1i.he· department so
that they may be conaidered together with all other municipal
estimates

Eatj,matea. 7. The estimates, as submitted by the chief, shall be in
the fonn required by the treasurer and shall i.r¡clude the amounts
to be paid for:
(a) the Elervices of the fire fi"ghters; .
(b) unifonns, clothing allowances and personal equipnent
for the fire fighters;
(c) office supplies and equi¡:ment and clerical
assistance;

(d) The Workmen's Compensation Act or benefit plan
approved by the Workmen's Compensation Board;
(e) Liability and insurance premiums;
~ contributions to any pension plan for full-time
fire fighters who are members of the department j
(g) membership ~~penses of bepresentatives attending
meetings of associations of fire marshals, fire
chiefs or fire fighters or any fire college or fire
school conducted by the Fire Marshal;
(h) the purchase of new fire apparatus and fire
fighting equi¡:ment¡
(i) the purchase of new fire alann and canmunication
systems and equipoent;
(j) the normal oper~tion, maintenance and repair of
fire apparatus, fire fighting equipnent and fire
alal'lÞ and communications system and equipnent;
.. the nonnal operation, maintenance and repair of
the fire hall;
OI!) the cost of altering, re-building or constructing
any fire hall;
.. any amount charged to the fire department for
h1drant rentals or water supplies; and
(n) any other items charged to the fire department.
Salaries. 8. Salaries and allowances to the officers and fire fighters
shall be. detennined by the council.
CaUe 9. The brigade shall not respond to any fire calls outside
outside the limits of the municipality, except, -
municipality.
(a) with respect to any fire which in the opinion of the chief
threatens any property within the municipality;
(b) to a municipality, or municipalities with which an agree-
ment has been entered into to provide fire protection on
a mutual aid basis or under any organized county mutual
aid plan; or
(c) to a municipality with which an agreemerlt has been entered
into to provide fire protection at an 8lnual rate or at a
fee per call; or
. where an agreement to provide fire protection on an annual·
rate or fee per call ba.sis has been entered into with a
company, organization or person whose property is situated
outside the municipal limits and distant not more than
fifteen miles therefran.

10. - (l) The chief shall have full charge of the conduct
and generð1. operation of the department, including fighting a
fire, responding to a fire alann, at drills Or practiëes, and
the care and maintenance of the fire hall and all apparatus,
equipnent and supplies.
(2) The chief shall, -
(a) maintain proper decorum, discipline and
efficiency of the department at fires, alarms
and practices and in the discharge of all depart-
ment duties insofar as they have a bearing on the
efficiency of the department or the care and
maintenance of the fire hall, apparatus, equipnent
and supplies;
(b) regularly inspect for fir ' ha~ards all manu-
facturing and mercantile premises, churches, schools,
institutions, public buildings and places of pu.blic
assembly, and on request inspect residences, and
designate any officer or fire fighter as fire pre-
vention inspector, to assist in such duties;
(c) maintain a book to record the attendance of
members of the department at fires I'.nd practices,
the particulars of every fire call and every fire
reported to the department and the apparatus,
equipnent and supplies used for each fire call, and
any breakages, shortages or deficiencies in the
apparatus, equipnent and supplies, and any other
information that may be required fran time to time
by the council;
(d) submit Ii report to the council a¡mual~, or
more often if requested, outlining the activities
of the department and the losses in life and
property suffered by fire;
(e) submit a report to the council immediately
of any injuries to members of the department that
occv<r.. while on duty, and in collaboration with the
cle.rkof the municipality forward a report of such
injury on the prescribed "Form" to the Workmen 's
Compensation Board;
(f) submit a report to the council inmediately of
any breakage~ shortages, or deficiencies in the
apparatus, equi¡ment and supplies, and any occurrences
requiring the suspension of any member of the depart¡nent;
and
(g) report promptly all fires to the Fire Marshal of
Qltario on the printed fonns supplied for such purpose
and otherwise comp:Jy with the provisions of the Fire
Marshals Act and Regulations thereunder and other
provincial laws for which the fire chief is the
enforcing officer.

11. The deputy chief shall carry out the instructions
of the chief and shall as sUllIe the dutiss of the chief in his
absence, and it shall be his duty to see that all apparatus,
equipnent and supplies are kept in a clean ånd serviceable
condition and ready for :lJDnediate use, and to instruct the
Captains to detail fire fighters for such duties when necess-
ary, and he shall report :lJDnediate~ to the chief any deficienc-
ies or untoward circUlllstances in connection with the same.
l2. The chief instructor shall be responsible to the
chief of the department for all phases of fire training, and
he shall establish a progressive syllabus of training in
accordance with the policy set forth in Section l5 of this
by-law, and he shall report in writing to the chief after
each scheduled practice those in attendance, those absent,
and subjects covered during the training, together with his
comments and recommendations.

The captains shall carry out the inatructions of their

:14. The fire fighters shall respond prottptly to all fire
alarms, and attend e.ll scheduled practices and obey all orders
and instructions of their officers. Absence from attendance at
fires or scheduled practices without justifiable reason may
result in suspension or dismissal from the department.
15. The department shall meet at least twice a month under
the supervision of the chief instructor for practice and instruct-
ion in the use of all apparatus, equipnent and supplies of the
department and in the principles of fire-fighting, fire prevention,
fire protection, and first aid to the injured.. A standard
training syllabus shall be established using the text books of
the Oklahoma A & M College.
16. The officer in charge of the department at any fire m8¥
cause any fence or any out-structure to be removed or torn down,
1.r such removal or tearing down appea.rs necessary to prevent the
spread of fire.

. 17. - (1) The members of the department may organize for
social purposes and other purposes intended: to further the
interest and welfare of the department and the members thereof.
(2) The department m8¥ at any time, subject to the approval
of t he counc~, have the use of t he fire hall or the council
chamber or the municipal hall at any convenient time for the
transaction of business or for social functions.
(3) No rule or regulation of any such social organization
shall in any W8¥ limit the authority of the fire chief in his
administration or operat ions of the department.
18. No person shall impede, interfere with or hinder any
officer or fire fighter in charge of his duties at a fire,
in responding to a fire alann or at a practice, and no person
shall damage apparatus, equipnent and supplies, and no person
shall put to any use not authorized by the chief an
apparatus, equipnent end supplies.

JI8nalties.
19. An7 person contravening any provision of this by-law
shall, upon conviction therefor, be liable to a fine not
exceeding $50.00, exclusive of costs, and every such penalty
shall be recoverable under the SmnmAry Convictions Act, or
to imprisonment for a term not exceeding.................
or to both such fine and imprisonment at the discretion of
the convicting magistrate. (for cities, IJIII,Yi"'",'1 imprison-
ment term not more than 6 months; in all other cases not
more than 21 days).
20. In case the provisions of this by-law conflict with
the provisions of any other by-law, the provisions of this
by-Law shall prevail.
