HomeMy WebLinkAbout04 096 tender fuel 2004 e .- e -e TIlE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2004 - 96 i I BEING A BY-LAW TO ACCEPT A TENDER FOR THE S~PPL Y AND DELIVERY OF GASOLINE, DIESEL FUEL, FURNACE OIL, fROPANE AND AVIATION FUEL WHEREAS the Municipal Act, 2001, S.. 2001,c.25 Sections 8 and 9 (1) provides municipalities with powers of a natural person to enable th m to govern their affairs as they consider appropriate under this or any other Act; WHEREAS the Council for The Corporation of the Municip lity of Kincardine deems it advisable to accept tenders for the supply and d livery of gasoline, diesel fuel, furnace oil, propane and aviation fuel at a fluctu ting discount rate pursuant to recommendations in Report PWM-2004-17; NOW THEREFORE the Council for The Corporation of t e Municipality of Kincardine ENACTS as follows: i 1. That the tender for unleaded gasoline, marked dies I, clear diesel and fumace oil, in the amount of approximately $263,07 .51 inclusive of all applicable taxes, be awarded to Edward Fuels; 2. That the tender for propane, in the amount of appro imately $21,834.19 inclusive of all applicable taxes be awarded to Superior ropane; 3. That the tender for aviation fuel in the amount of appro imately $37,836.00 inclusive of all applicable taxes be awarded to Graham nergy Limited; 4. That the contract period of supply of fuels for each a arded tender noted above be from July 1, 2004 to June 30, 2006 (two year eriod); 5. That any price changes as a result of tax increas s or reductions be effective on the date identified by the Federal/Provincia authority; 6. That price decreases be effective immediately upon n tice. 7. That report PWM-20Q4-17 and bid documents be attac ed to this by-law as Schedule "A". That the Mayor and CAO be hereby authorized to si n, on behalf of the Council for The Corporation of the Municipality of Kin rdine any contracts and other documents required and to affix the co po rate seal of The Municipality of Kincardine. DESCRIPTION Contract No. 2004-14 - Supply of Unleaded Gasoline at a discount of S.063/litre, Diesel Marked at a discount of $.048/litre, L.S. Diesel at a discount of $.04S/litre, and Furnace Oil at a discount of $.100IIitre for a period of two years (July 1", 2004 to June 30th, 2006). IN CONSIDERATION WHEREOF, said party of the second part agrees to pay to the Contractor for all work done, and the unit prices on the Tender. This agreement shall ensure to the benefit of and the binding upon the heirs, executors, administrators and assigns of the parties hereto. None Total Savings , None " · "Schedule A" Page 1 Municipality of Kincardine Invitational Bid for the Supply and Delivery of Gasoline, Diesel Fuel, Furnace Oil, Propane, and Aviation Fuel Tender No. 2004-14 Sealed Invitational Bid clearly marked as to the contents will be received by Jim O'Rourke, Public Works Manager for the Supply of Gasoline, Diesel Fuel, Fumace Oil, Propane, and Aviation Fuel until 12:00 Noon local time on June 8th, 2004. Bidders have the option of bidding on all products or specific products. Interested suppliers are invited to submit bids for the Supply and Delivery of Gasoline, Diesel Fuel, Furnace Oil, Propane, and Aviation Fuel to the Municipality of Kincardine for a period of 24 months commencing July 1'\ 2004 and expiring on June 30th, 2006. Instructions to Bidders · 1. 2. 3. 4. · 7. 8. 9. Bid prices must be submitted on the enclosed forms only, otherwise bids that do not comply strictly with the terms and conditions may be disqualified. Tenders that are incomplete, or conditional maybe rejected. Tender forms must be fully completed and signed according to the requirements of the form by a responsible official of the bidding firm. Your signed tender shall be taken as your statement that you understand the requirements and agree to comply with it and any terms and conditions stated in the tender form. 5. Prices submitted on the bid sheet must include Federal Excise Tax, Provincial Road Tax and Goods and Services Tax. Goods and Services Tax will be shown separately on each invoice. 6. Price adjustments imposed by the Federal or Provincial Govemments will only become effective on the date(s) and or upon the expiry of all stipulated waiting period(s), whichever is longer. Price changes as a result of tax increases or reductions will be effective on the date identified by the Federal/Provincial authority. Price decreases will be effective immediately upon notice. It shall be the responsibility of the successful bidder to assure an uninterrupted supply of all proposed products to all storage facilities. · · · ," "Schedule A" Tender No. 2004-14 Page 2 10. The quantities shown are best estimates only based on expected usage. These quantities are not guaranteed used and are fumished without any liability to the Municipality. 11. The Municipality of Kincardine reserves the right to reject any or all proposals and the lowest or any proposal will not necessarily be accepted. 12. The Municipality of Kincardine reserves the right to accept any proposal, which is considered best for the interest of the Municipality. 13. The Municipality of Kincardine reserves the right to cancellation of this contract upon 30 days written notice. 14. The successful bidder shall indemnify the Municipality from and against all liability under such statutes, laws and regulations and in respect to all claims that may arise or be made against the Municipality at common law or otherwise by reason of injury or death of any person(s) or employee(s) of the successful bidder and sub-contractor employed in the work. 15. The successful bidder, their agents, all workers and persons employed by them or under their contract will use due care that nò person(s) are injured and that no property is damaged in the prosecution of the work. The successful bidder will be solely responsible for all such damages to persons or property including theft, whether the property is owned by the Municipality or any of their employees. NOTE: IMPORTANT The discount offered per litre on the bid page must be consistently given to the Municipality of Kincardine. The Municipality of Kincardine will check the pump price compared to your invoiced price to ensure the discounted price has been billed. The Municipality of Kincardine reserves the right to increase or decrease the estimated quantities. Any reductions in prices per litre due to quantity increases are to be passed on to the Municipality of Kincardine.
