Being a By-law to Amend Zoning By-law No. 2003 - 25, being the
Comprehensive Zoning By-law for the Municipality of Kincardine
Bradstones Developments Inc.
PART LOT 18, CONCESSION A, KINCARDINE, PART 1, PLAN 3R-10519;
TOGETHER WITH AN EASEMENT OVER PART LOT 18, CONCESSION A,
KINCARDINE, PART 2, PLAN 3R-10519 AS IN BR164551; MUNICIPALITY OF
KINCARDINE
Whereas Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws which comply with
an approved official plan; and
Whereas the Council of The Corporation of the Municipality of Kincardine has
enacted By-law 2003- 25, a zoning by-law enacted under Section 34 of the said
Planning Act; and
Whereas Council passed By-law No. 2020 - 142 on November 9th, 2020 which
amended By-law No. 2003 -25 to include a Holding (H) Provision on certain lands;
and
Whereas all the conditions of the Holding (H) Provision have been satisfied; and
Whereas the Council of The Corporation of the Municipality of Kincardine desires
to amend By-law 2003 - 25; now therefore be it
Resolved that the Council of The Corporation of the Municipality of Kincardine
Enacts as follows:
1. Schedule 'A' to By-law No. 2003 - 25 as amended, is hereby further
amended by changing the zoning from ‘‘R3-y-H” to “R3-y” the zoning
designation of those lands described CONCESSION A PT LOT 18 PLAN
3R10519 PART 1, TOGETHER WITH AN EASEMENT OVER PT LOT 18
CONCESSION A, PT 2 3R10519 AS IN BR164551, Municipality of
Kincardine, County of Bruce, outlined on the attached Schedule ‘A’
2. This By-law takes effect from the date of passage by Council and comes
into force and effect pursuant to the provisions of the Planning Act, R.S.O.
1990.
3. This By-law may be cited as the “Amendment to Comprehensive Zoning
By-law No. 2003-25, Holding Removal (Bradstones) By-law”.
Read a First and Second Time this 10th day of July, 2023.
READ a THIRD TIME and FINALLY PASSED this10th day of July, 2023.
