HomeMy WebLinkAbout04 085 zoning Fulford 82-08 e e e e TIlE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW No. 2004 -85 BEING A BY -LAW TO AMEND ZONING BY -LAW NO 82.08, BEING THE COMPREHENSIVE ZONING BY·LAW F R THE TOWNSHIP OF KINCARDINE Jennifer Fulford, Part Lot 47 to Part Lot 49, Concession 'A' (being rt 1 on RP 3R-6716), Municipality of Kincardine (former Township of Klnca Ine) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 au orizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approv official plan; AND WHEREAS the Council of the Corporation of the Township of Kincardine h s enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Corporation of the Township of Kincardine has restructur d to now be a part of the Corporation of the Mun icipality of Kincardine; AND WHEREAS the Council of the Corporation of the Municipality of Kincardin~ desires to amend By-law 82-08; NOW THEREFORE the Council of the Corporation of the Municipality of Kincar ine ENACTS as follows: 1. Schedule 'A' to By-law No. 82-08 as amended, is hereby further amend d by changing thereon from 'A1' to 'A1-2004-65a' and 'A1-2004-65b', the zoning designation 0 those lands described as Part Lot 47 to Part Lot 49, Concession 'A' (being Part 1 on RP 3R-6716 ,Municipality of Kincardine (former Township of Kincardine) which are outlined on the a ched Schedule 'A'. 2. By-Law No. 82-08, as amended, being the Comprehensive Zoning By- w for the Township of Kincardine, is hereby further amended by adding the following paragra hs to Section 9.3 thereof: 9.3.49 (a) Notwithstanding their 'A l' Zoning designation, those I ds described as Part Lot 47 to Part Lot 49, Concession 'A' (being Part 1 on R 3R-6716), Municipality of Kincardine (former Township of Kincardine), and delin ated as 'A1-2004-65a' on Schedule 'A' to this By-law may be used for non-fa residential purposes in compliance with the 'A l' Zone provisions contained in this By-law, excepting however, that: (i) The number of livestock units shall be limit to 3.7 livestock units per hectare; (ii) The minimum rear yard setback shall be 1.5 m (5.0 ft). 9.3.49 (b) Notwithstanding their 'A l' Zoning designation, those I nds described as Part Lot 47 to Part Lot 49, Concession 'A' (being Part 1 on R 3R-6716), Municipality of Kincardine (former Township of Kincardine), and delin ated as 'A1-2004-65b' on Schedule 'A' to this By-law may be used for gene I agricultural purposes in compliance with the 'A1' Zone provisions contained .in this By-law, excepting however, that: (i) The construction of any new residential buildi s and/or structures of any type shall be prohibited. 3. This By-law takes effect from the date of passage by Council and com s into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. .../2 e e e e 4.
