BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 82-G8,
BEING THE ZONING BY-LAW FOR TH
TOWNSHIP OF KINCARDINE I

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws hich comply with an
approved official plan; I
AND WHEREAS the Council of the Corporation of the Townsh~p of Kincardine has
enacted By-law 82-08, a zoning by-law enacted under Section 34{ of the said Planning

AND WHEREAS the Corporation of the Township of Kincardine h s restructured to now
be a part of the Corporation of the Municipality of Kincardine;
AND WHEREAS the Council of the Corporation of the Muni ipaliw of Kincardine
desires to amend By-law 82-08; .
NOW THEREFORE the Council of the Corporation of the Muni~iPality of Kincardine
ENACTS as follows: '
1.
Schedule 'A'to By-law No. 82-08 as amended, is hereby fu her amended by
changing thereon from 'A1' to '051-1' and from 'EP' to 'EP 'the zoning
designation of those lands described as North Part Lot 51, on cession 'C',
Municipality of Kincardine (former Township of Kincardine), hich are outlined on
the attached Schedule 'A'.
2. By-law 82-08, as amended, is hereby further amended b adding the following
subsection to Section 29 thereof:
29.4.1
Notwithstanding their '051' zoning desi nation, those lands
described as North Part Lot 51, Concessi n 'C', Municipality of
Kincardine (former Township of Kincardine) and identified by the
zone symbol '051-1' on Schedule 'A' to this By-law, shall be used
in compliance with the '051' zone provision contained in this By-
law, excepting, however, that:
i) the layout of buildings and structures a they existed as of
February 2004 shall not be changed or alte d without the written
prior approval of the Saugeen Valley Cons rvation Authority and
any applicable approval authority.
ii) the lands shall be subject to Site Plan Cont I.

By-law 82-08, as amended, is hereby further amended by aØding the following
subsection to Section 31 thereof: '
31.4.5
Notwithstanding their 'EP' zoning designation, th~se lands
described as North Part Lot 51, Concession 'C', Municipality of
Kincardine (former Township of Kincardine) and 'dentified by the
zone symbol 'EP-4' on Schedule 'A' to this By-law, shall be used in
compliance with the 'EP' zone provisions contai~ed in this By-law,
excepting,' however, that: ¡

i) a golf course shall be a permitted use;
ii) buildings and/or structures, except those exist,ng as of the date
of passage of this by-law, shall be prohibited wit~ the exception of
those structures permitted in 'Section 31.1 - Us~s Permitted';
iii) site alteration, regrading, filling, or excavatin~ ~n all lands in the
'EP-4 zone shall be prohibited except as permittj3d through Site
Plan Control; ,
iv) the lands shall be subject to Site Plan Contro'.

This By-law takes effect from the date of passage by Council ~nd comes into
force and effect pursuant to the provisions ofthe Planning Act, R.S.O. 1990.

5. This By-law may be cited as the "Amendment to Comprehen~ive Zoning By-law
82-08, (North Part Lot 51, Concession 'C', Municipality of Kin~ardine (former
Township of Kincardine)), By-Law".
