No. 2004 - 83
BEING A BY-LAW TO AMEND ZONING BY-LAW 0.2003-25.
BEING THE COMPREHENSIVE ZONING BY -~ FOR THE
MUNICIPALITY OF KINCARDINE

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chap er 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws hich comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipa'ity of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Seftion 34 of the said
Planning Act; I
AND WHEREAS the Council of the Corporation of the Muni ipality of Kincardine
desires to amend By-law 2003-25;
NOW THEREFORE the Council of the Corporation of the Mun ipality of Kincardine
ENACTS as follows:
1.
Schedule 'A' to By-law No. 2003-25 as amended, is hereby urther amended by
changing thereon from 'A2' to 'OS-a' and from 'EP' to 'EP-f he zoning
designation of those lands described as North Part Lot 51, oncession 'C',
Municipality of Kincardine (former Township of Kincardine), hich are outlined on
the attached Schedule 'A'.
2. By-law 2003-25, as amended, is hereby further amended b adding the following
subsection to Section 32 thereof:
32.3.1 Notwithstanding their 'OS' zoning desig ation, those lands
described as North Part Lot 51, Concessio 'C', Municipality of
Kincardine (former Township of Kincardine) and identified by the
zone symbol 'OS-a' on Schedule 'A' to this B -law, shall be used in
compliance with the 'OS' zone provisions co tained in this By-law,
excepting, however, that:
i) the layout of buildings and structures a they existed as of
February 2004 shall not be changed or alter d without the written
prior approval of the Saugeen Valley Cons rvation Authority and
any applicable approval authority.
ii) the lands shall be subject to Site Plan Cont I.

Amendment to Zoning By-law 2003 - 25 (Somerhill G If Club)
By-law 2003-25, as amended, is hereby further amended by!adding the following
subsection to Section 34 thereof: .
34.6.6
Notwithstanding their 'EP' zoning designation, t~ose lands
described as North Part Lot 51, Concession 'C'~MuniciPality of
Kincardine (former Township of Kincardine) an identified by the
zone symbol 'EP-f on Schedule 'A' to this By-Ia ,shall be used in
compliance with the 'EP' zone provisions contailned in this By-law,
excepting, however, that:
i) a golf course shall be a permitted use;
ii) buildings and/or structures, except those exis~ing as of the date
of passage of this by-law, shall be prohibited w~h the exception of
those structures permitted in 'Section 34.2 Stru~tures Prohibited -
Environmental Protection Zone'; .
Iii) site alteration, regrading, filling, or excavating on all lands in the
'EP-f zone shall be prohibited except as permittþd through Site
Plan Control;
iv) the lands shall be subject to Site Plan Contrql.
4. This By-law takes effect from the date of passage by Council ßnd comes into
force and effect pursuant to the provisions of the Planning Ac" R.S.O. 1990.
5. This By-law may be cited as the "Amendment to Comprehen~ive Zoning By-law
2003-25, (North Part Lot 51, Concession 'C', Municipality of KIncardine (former
Township of Kincardine», By-Law".
