HomeMy WebLinkAbout05 163 Rd Closure Christmas BIA e e e e I THE CORPORATION OF THE MUNICIPALITY OF KINCAiWINE KB' BY-LAW NO. 2005 - 163 BEING A BY-LAW TO TEMPORARILY CLOSE STREETS TO FACILITATE A KINCARDINE BUSINESS IMPROVEMENT AREA HOME TO~ CHRISTMAS WHEREAS the Municipal Act, 2001, S.D. 2001, c. 25, Sectiont' 8 and 9 provide municipalities with powers of a natural person to enable them to g vern their affairs as they consider appropriate and to enhance their ability to respond to , unicipal issues; AND WHEREAS pursuant to the said Municipal Act, Section 11 (2) þrovides that lower- tier municipalities may pass by-laws within the sphere of jurisdliction of highways, including parking and traffic on highways; AND WHEREAS the Board of Management of the Kincardine Bu~iness Improvement Area has requested the closure of certain streets in order to hol~ its annual "Home Town Christmas" activities on Friday, November 18, 2005; NOW THEREFORE the Council for The Corporation of the Munic~pality of Kincardine ENACTS as follows: ' 1. That part of Queen Street, from the north side of Durha~ Market South to Durham Street; and Durham Market North, east of Quee~ Street to Princes Street, be closed to all vehicular traffic, other than those ve~icles authorized by the organizers, on Friday, November 18,2005 from 5:00 p.ml to 10:00 p.m. The Board of Management of the Kincardine B.IA shall e~ect at each end of such highway or portion thereof, and where an alterna~ive route deviates therefore, a barricade upon which an adequate warning devi(þe shall be exposed and in good working order continuously from sunset until ~unrise and at such points there shall be erected a detour sign indicating the alternative route and containing a notice that the highway is closed to traffic. 2. 3. Every person who uses a highway or portion of a highway ISO closed to traffic does so at his or her own risk and The Corporation of Ithe Municipality of Kincardine is not liable for any damage sustained by a perso~ using the highway or portion thereof so closed to traffic. Every person who without lawful authority uses a highway or portion thereof so closed to traffic while it is protected in accordance with this paragraph, or who removes or defaces any barricade, device, detour sign or nqtice placed thereon by lawful authority, is guilty of an offence and is subject to ì/le penalties as set forth in the Provincial Offences Act and is also liable to ThE1 Corporation of the Municipality of Kincardine for any damage or injury occasion~d by such wrongful use, removal or defacement. 4. . . ./2 e e e e Page 2 Kincardine BIA Home Town Christmas Temporary Road losure By-law No. 2005 - 163 I , I i This by law shall come into full force and effect upon its final ~assage.
