HomeMy WebLinkAbout04 086 zoning Fulford 2003-25 e e e e TIlE CORPORATION OF TIlE MUNICIPALITY OF KINC INE BY-LAW No. 2004 - 86 BEING A BY·LAW TO AMEND ZONING BY-LAW NO. 03-25, BEING THE COMPREHENSIVE ZONING BY-LAW F R THE MUNICIPALITY OF KINCARDINE Jennifer Fulford, Part Lot 47 to Part Lot 49, Concession 'A' (being art 1 on RP 3R-6716), Municipality of Kincardine (former Township of Klnca 'ne) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 au oozes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approve official plan; AND WHEREAS the Council of the Corporation of the Municipality of Kinca Ine has enacted By-law 2003-25, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By-law 2003-25; NOW THEREFORE the Council of the Corporation of the Municipality of Kincard ne ENACTS as follows: 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further ame ded by changing thereon from 'A2' to 'A2-a' and 'A2-f, the zoning designation of those lands desc ibed as Part Lot 47 to Part Lot 49, Concession 'A' (being Part 1 on RP 3R-6716), Municipality f Kincardine (former Township of Kincardine) which are outlined on the attached Schedule 'A. 2. By-Law No. 2003-25, as amended, being the Comprehensive Zoning B Law for the Municipality of Kincardine, Is hereby further amended by adding the following parag phs to subsection 10.3 thereof: Notwithstanding their 'A2' Zoning designation, those la ds described as Part Lot 47 to Part Lot 49, Concession 'A' (being Part 1 on RP 3R-6716), Municipality of Kincardine (former Township of Kincardine), and elineated as 'A2-f on Schedule 'A' to this By-law may be used for non-fa residential purposes in compliance with the 'A2' Zone provisions contained n this By-law, excepting however, that: 10.3.6 (I) The number of livestock units shall be limited to 3.7 livestock units per hectare; (ii) The minimum rear yard setback shall be 1.5 m 5.0 ft). 3. This By-law takes effect from the date of passage by Council and come into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 4. This By-law may be cited as the "Amendment to Comprehensive Zonin By-law 2003-25, (Part Lot 47 to Part Lot 49, Concession 'A' (being Part 1 on RP 3R-6716), Mu iclpality of Kincardine (former Township of Kincardine)), By-Law".
