HomeMy WebLinkAbout05 147 Amend 82-08 restricted a e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE No. 2005 -147 BEING A BY·LAW TO AMEND ZONING BY-LAW 0.82-08, BEING THE RESTRICTED AREA ZONING BY·LAW FO THE FORMER TOWNSHIP OF KINCARDINE H.J. Sieber Farms Ltd. (Helga Sieber) c/o Allen . Wickert, Part Lots 36 and 37, Concession 'A', Municipality of Kincardine (former Township of Kincardine) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapte 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws w ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Townshi of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 f the said Planning Act; AND WHEREAS the Corporation of the Township of Kincardine has restructured to now be a part of the Corporation of the Municipality of Kincardine; AND WHEREAS the Council of the Corporation of the Munici ality of Kincardine desires to amend By-law 82-08; NOW THEREFORE the Council of the Corporation of the Munic'pality of Kincardine ENACTS as follows: 1. Schedule 'A'to By-law No. 82-08 as amended, is hereby furt er amended by changing thereon from 'A1' to 'A1-73a' and 'A1-73b' the zoni g designation of those lands described as Part Lots 36 and 37, Concession' ',Municipality of Kincardine (former Township of Kincardine) which are outlin on the attached Schedule 'A'. 2. By-law No. 82-08, as amended, being the Zoning By-law for he former Township of Kincardine, is hereby further amended by adding the folio ing paragraph to subsection 9.3 thereof: 9.3.57 (a) Notwithstanding their 'A1' zoning design tion, those lands delineated as 'A1-73a' on Schedule 'A' to this y-Iaw may be used for 'Non-farm Residential' purposes in comp iance with the 'A1' zone provisions contained in this By-law, excep ing however, that: (i) (ii) The number of livestock units shall be Ii ited to 3.7 livestock units per hectare; and The setbacks for all buildings and struct res shall be no less than as they existed as of the date of th passing of this By- law. All further enlargements, expansio s, construction etc. shall comply with the requirements of B law 82-08. .../2 e e e e Page 2 By-law No. 2005 - 147 Amend Zoning By-law 82-08 Part Lots 36 and 37, Conc ssion A (b) Notwithstanding their 'A1' zoning designa ion, those lands delineated as 'A1-73b' on Schedule 'A' to this y-Iaw may be used for 'Non-Residential' purposes in compliance ith the 'A1' zone provisions contained in this By-law, excepting h wever, that: (i) The construction of any new residenti I buildings and/or structures shall be prohibited. 3. This By-law takes effect from the date of passage by Council nd comes into force and effect pursuant to the provisions of the Planning Ac , R.S.O. 1990. 4. This By-law may be cited as the "Amendment to Restricted A ea Zoning By-law 82-08, (Part Lots 36 and 37, Concession 'A', Municipality of incardine (former Township of Kincardine», By-law".
