SPONSORED CALYPSO STREET MARKET EV NT WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, Section 8 and 9 provide municipalities with powers of a natural person to enable them to g vem their affairs as they consider appropriate and to enhance their ability to respond to municipal issues; AND WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, Sectio 11 (2) provides that lower-tier municipalities may pass by-laws within the sphere of juri diction of highways, including parking and traffic on highways; AND WHEREAS the Kincardine Business Improvement Area 'shes close Queen Street from Durham Market North to Durham Street on Sunday, Au ust 1, 2004 from 12 noon to 4:00 p.m. in order to hold a Calypso Street Market Event; , NOW THEREFORE the Council for The Corporation of the Muni!iPality of Kincardine ENACTS as follows: 1. That part of Queen Street, from Durham Market North t Durham Street, be closed to all vehicular traffic on Sunday, August 1, 2004 fro 12:00 noon to 4:00 p.m. for the purpose of holding the B.I.A. Calypso Street Ma et Event; 2. The Board of Management of the Kincardine B.I.A. shall rect at each end of such highway or portion thereof, and where an altern tive route deviates therefore, a barricade upon which an adequate warning de ice shall be exposed and in good working order continuously from sunset until sunrise and at such points there shall be erected a detour sign indicating the· Itemative route and containing a notice that the highway is closed to traffic. 3. Every person who uses a highway or portion of a highwa so closed to traffic does so at his or her own risk and The Corporation 0 the Municipality of Kincardine is not liable for any damage sustained by a pers n using the highway or portion thereof so closed to traffic. 4. Every person who without lawful authority uses a highway or portion thereof so closed to traffic while it is protected in accordance with th s paragraph, or who removes or defaces any barricade, device, detour sign or otice placed thereon by lawful authority, is guilty of an offence and is subject t the penalties as set forth in the Provincial Offences Act and is also liable to T e Corporation of the Municipality of Kincardine for any damage or injury occasio ed by such wrongful use, removal or defacement. . . ./2 - e e - B.IA Calypso Street Market Road Closing (2004) B -Law By-law No. 2004 - 77 Page 2 5. 6. This by law shall come into full force and effect upon its final þassage. This by-law may be cited as the "B.I.A. Calypso Street Market Road Closing (2004) By-law". .
