THE CORPORATION OF THE TCYIiNSHIP OF KINCARDINE BY-LAW NO. b '1-.2.J- A BY-LAW TO REGULATE THE USE OF LAND THE CHARACTER, LOCATION, AND USE OF BUILDINGS AND STRUCTURES The Council of the Corporation of the Township of Kincardine enacts as follows: 1. The provisions of this by-law shall apply to the follOW'ing area: " A part of Lots 18, 19 and 20, Concession "An, ship of Kincardine, County of Bruce as sbown on Scbedule "A" attacbed bereto. 2. (1) Except as hereinafter provided in this by-law, no person shall use any land in the defined area except for residential purposes and no person shall erect or úse any building for any purpose other than as a single-family dwelling. (2) For the purposes of this by-law, a single- family dwelling means a building occupied, or intended to be occupied, as a dwelling by one femily alone end containing only one kitchen, and III8iY include usual accessory buildings. (3) For the purposes of this by-law, accessory buildings III8iY include a private garage. (4) Nothing in this sectiOJl shall prevent the occupant of a single-family dwelling carrying on any domestic or household art not afflicting the amenity of the neighbourhood or, of a profession person, trom occupying not more than 25% of the floor area. providing there is no displ8ð' of go or advertising ather than a plate not larger than one square .foot, but no person shall c!arry on the business of operating a rooming house or boarding (1) . "operating a rOaring house or boarding house" shall be construed to meen providing eithe sleeping accommodation or meals, or both, for monetary consideration to more than three persons. 3. (1) Where masonry construction of solid brick, brick veneer or stone is used the minimum floor area, exclusive of garages, basement, verandah 0 attic, shall be 1,150 square feet. (2) Where frame or other construction is used th minimum floor area, exclusive of garages, baseme verendah or attic shall be 1,300 square 1'eet. (3) For the purposes 01' calculating the 1'l00r ar in one end one-half storey dwellings, only that tion 01' the half storey having a minimum ceiling height of seven teet, six inches shall be comput d. (4) Where a full basement is not provided in a dwelling, the minimum ground floor area shall be increased by 100 square feet. 4. . No dwelling. including accessory buildings, shal occupy more than 30 per cent of the area of the building lot or parcel on which it is situated. 6. No dwelling shall be erected on a building lot 0 parcel of land which is less than 5,000 square f et in area and which has a frontage of less than 50 feet. 7. Not more then one dwelling shall be erected or placed on any lot as shown on the plan 01' subdi- vision covering the defined area. 8. No part of any dwelling or accessory building sh 1 be erected or placed at a distance less then 25 feet from a street or road boundary, nor less th 25 feet from the rear lot line except when an ac es- sory building is located in a rear yard in which case only 4 feet is required. This by-law shall not apply to any land or buil . ng which, on the d8¥ of the passing of this by-law, is used or erected for any purpose prohibited by t s by-law, so long as it continues to be used 1'or t at purpose, nor shall this by-law apply to any buil ing the plans for which have prior to the d8¥ 0 the passing of the by-law been approved by the municipal architect or building inspector, so 1 g as the building when erected is used for the pose for which it was erected. 13. Any person who contravenes this by-law shall be guilty of an offence and shall be liable to a penalty ot not more than $300.00, exclusive of costs. 14. This by-law shall come into force on the date it is passed by council, subject to the approval 0 the Ontario Municipal Board.
