HomeMy WebLinkAbout04 074 road clos scot fest e e e e THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2004 - 74 BEING A BY·LAW TO TEMPORARILY CLOSE STREETS TO HOLD A KINCARDINE SCOTTISH FESTIVAL I I WHEREAS Section 42 of the Municipal Act, 2001, S.O. 2001, c. 25, a amended, authorizes councils of all municipalities to close on a temporary basis any highway nder the jurisdiction of the municipality for such social, recreational, community, athletic or cine a-graphic purpose as may be specified in a by-law; AND WHEREAS the Kincardine Scottish Festival and Highland Games ishes to hold an event July 2-4, 2004 at Victoria Park in the Municipality of Kincardine; NOW THEREFORE the Council for The Corporation of the Municipality f Kincardine ENACTS as follows: . I 1. . That Durham Market South be closed to all vehicular traffic from ~:oo p.m. on Friday, July 2, 2004 until 6:00 p.m. on Sunday, July 4, 2004. 2. That Durham Market North, that portion of Russell Street from P nces Street to Olde Victoria Street and that portion of Princes Street N. from Lamb on Street South be closed to all vehicular traffic on Saturday, July 3, 2004 from 6:00 .m. to 7:00 p.m. 3. That the west side of Huron Terrace between Durham and ambton Streets be designated a "No Parking" area from 11:00 a.m. to 1:00 p.m. n Saturday, July 3, 2004. 4. That municipal land located at the corner of Albert and Victoria St eet be designated a parking area July 3, 2004 to allow for visitors to be shuttled to the vent. The Kincardine Scottish Festival shall erect at each end of s ch highway or portion thereof, and where an alternative route deviates therefore, a rricade upon which an adequate warning device shall be exposed and in good working rder continuously from sunset until sunrise and at such points there shall be erected a d tour sign indicating the alternative route and containing a notice that the highway is close to traffic. 5. Every person who uses a highway or portion of a highway so clo ed to traffic does so at his or her own risk and The Corporation of the Municipality of Ki cardine is not liable for any damage sustained by a person using the highway or porti n thereof so closed to traffic. 6. Every person who without lawful authority uses a highway or porti n thereof so closed to traffic while it is protected in accordance with this paragraph, or 0 removes or defaces any barricade, device, detour sign or notice placed thereon by la ul authority, is guilty of an offence and is subject to the penalties as set forth in the P vincial Offences Act and is also liable to the The Corporation of the Municipality of Ki cardine for any damage or injury occasioned by such wrongful use, removal or d facement. 7. .../2 e e - - By-Law No. 2004 -74 Scottish Festival 2004, Temporary Street Closure, By-law Page 2 of 2 8. This by-law shall come into full force and effect upon its final passage. I 9. This by-law may be cited as the "Scottish Festival 2004, Temporafy Street Closure, By- law".
