THE CORPORATION OF THE MUNICIPALITY OF KINCA INE
BY-LAW
NO. 2005 ·144
BEING A BY·LAW TO ACCEPT A TENDER FOR HE
RECONSTRUCTION OF RUSSELL STREET, MUNICIPAL TV OF
KINCARDINE
(Lavis Contracting Co. Limited)
WHEREAS Section 44 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended,
provides that a municipality that has jurisdiction over a highw y or bridge shall
keep it in a state of repair that is reasonable in the circumstance ;
AND WHEREAS pursuant to the said Municipal Act, Sections ~and 9 (1) provide
municipalities with the powers of a natural person to enable th m to govem their
affairs as they consider appropriate under this or any other A and to enhance
their ability to respond to municipal issues; ,

AND WHEREAS it has been determined that there is a ne d to reconstruct
portions of Russell Street, including bridge repairs and road wo ;
AND WHEREAS the Council for The Corporation of the Municip lity of Kincardine
deems it expedient to accept a tender received by Lavis Con racting Company
Limited to reconstruct and repair bridge and road work on ussell Street as
determined by Cont~ct No. 05024; I
NOW THEREFORE the Council for The Corporation of thþ Municipality of
Kincardine ENACTS as follows:
That the tender of Lavis Contracting Company Limited in the amount of
$560,638.00, inclusive of all applicable taxes, for the reconstruction of
Russell Street, be hereby accepted.
2. That the Mayor and CAO be hereby authorized to sign on behalf of the
Council for The Corporation of the Municipality of Kincar ine, any contracts
and other documents required to authorize such work to ommence.

3. That this by-law shall come into full force and effect upon its final passage.
4. That this by-law may be cited as the "Russell Street Rec nstruction (Lavis)
Tender Acceptance By-law".
