THE CORPORATION OF THE MUNICIPALITY OF BY-LAW BY-LAW NO.2005 -142 BEING A BY-LAW TO AMEND THE RULES AND REGUL LTIONS FOR THE MAINTENANCE AND OPERATION OF, AND CONNECTION O, THE EXPANDED SERVICE AREA OF THE KINCARDINE WATER TREATME 4T PLANT AND TO PROVIDE PENALTIES FOR VIOLATIONS THE REOF WHEREAS the Council of the Municipality of Kincardine passed By-law 2004-55 • on April 21st, 2004 being a by law to enact rules and regulations for the maintenance and operation of, and connection to, a system of municipal water works for properties and highways contained in the Kincardine Water Treatment Plant Expanded Service Area; i AND WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 Section 11 (2) provides that lower -tier municipalities may pass by-laws within the sphere of jurisdiction of fire protection and water production, treatme t, storage and distribution; AND WHEREAS Section 326 of the Municipal Act, 2001, S. . 2001, c. 25, provides that a municipality may designate an area of the mun cipality in which the residents and property owners receive or will receive an additional benefit from a prescribed special service that is not received in oth a1r areas of the municipality; AND WHEREAS Ontario Regulation 305/02 provides that fire protection and water systems are two of the prescribed special services for the purposes of • clause 326(1)(a) of the Municipal Act, 2001, S.O. 2001 AND WHEREAS Section 391 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, provides that a municipality may pass by-laws imposing chargeE on any class of persons for capital costs payable by it for fire and water services which will be provided by it; • AND WHEREAS Section 391 (2) of the Municipal Act 2001, S.O. 2001, c. 25, provides that a fee or charge imposed under subsection (1) or capital costs related to sewage or water services or activities may be imposed on persons not receiving an immediate benefit from the services or activities but who will receive a benefit at some later point in time; AND WHEREAS Section 396 (1) (a) of the Municipal Act 2001, provides that a by-law passed under Part XII of the Act may pr charges and other penalties, including the payment of collectic and charges that are due and unpaid and (b) discounts and c early payment of fees and charges; and (c) fees and charges basis the municipality considers appropriate and specifies in the O. 2001, c. 25, fide for interest costs for fees ier benefits for iat vary on any .../2 2 Amendment to Expanded Service Area Water By-law No. 2005 -142 • AND WHEREAS Section 396 (2) of the Municipal Act 2001, S., provides that a by-law passed under Part XII of the Act shall provic details setting out when and in what manner fees and charges are interest charges and other penalties, if any, for fees and charge and unpaid and discounts and other benefits, if any, for early p; and charges are to be paid; 0 L' AND WHEREAS Section 398 (1) of the Municipal Act 2001, provide that a fees and charges imposed by a municipality a the person to the municipality; AND WHEREAS Section 398 (2) of the Municipal Act 2001, provides that Treasurer of a local municipality may add fe imposed by the municipality under this Part to the tax roll property in the local municipality and collect them in the municipal taxes: 1. in the case of fees and charges for the supply of a property to which the public utility was supplied 2. in all other cases, any property for which all of responsible for paying the fees and charges AND WHEREAS it is the policy of the Municipality of water and sewer contributions to reserve funds; NOW THEREFORE the Council of the Municipality of follows: DEFINITIONS 1. In this by-law: (a) "Municipality" shall mean the Corporation of Kincardine. (i) "Communal Well" shall mean a well supplying pota le water to six (6) or more Properties as of June 30"', 2003. (j) "E.R.U." shall mean Equivalent Residential Unit ( 'th one E.R.U. being equal to a single detached dwelling). (k) "Mandatory Hook-up" shall mean any Benefiting ater Property located in the subdivisions of Craig Eskrick, Port Head Estates, • KinHuron or Lake Huron Highlands or which received its supply of potable water from a Communal Well prior to June PO, 2003. (1) "Optional Hook-up" shall mean any Property in� the Kincardine Water Treatment Plant Expanded Service Are, re that is not a Mandatory Hook-up. (m) "Total Fire Equivalent Residential Units (E.R.U.s�shall mean the total E.R.U.s, as determined by the Water Pury yor, located on Benefiting Fire Properties. (n) "Fire Capital Costs" shall mean the total costs incurred by the Municipality of Kincardine to install hydran and related appurtenances in the Kincardine Water Treatment Plant Expanded Service Area. (o) "Fire Capital Charge" shall mean the portion of he Fire Capital Costs assessed to each Benefiting Fire Landowne • (p) "Total Pipeline Equivalent Residential Units (E.R U.$) shall mean the total Era's, as determined by the Water Pu yor, located on Benefiting Water Properties. (q) "Pipeline Capital Costs" shall mean total costs I incurred by the Municipality of Kincardine to install the water mains and water services in the Kincardine Water Treatment Plant Expanded Service Area. (r) "Pipeline Capital Charge" shall mean !heportioo of the Pipeline Capital Costs assessed to each Benefiting Water andowner. (s) "Occupied Land" shall mean a Property in the incardine Water Treatment Plant Expanded Service Area on hich a building existed as of December 31, 2004. (t) "Vacant Land" shall mean a Property that December 31, 2004 but for which a Building • obtained. (a) No person shall make any connection to the Muni ipality s Water Works System without first having obtained a permit from the Building Department, and such permit shall be called the "Plumbing Permit". (b) No Plumbing Permit shall be issued until payment of Capital Costs, as per Schedule "B", has been received by the Municipality. WATER SERVICE CONNECTIONS 5. No connection shall be made to the Municipalitys Water �Ilork's System without the consent of the Water Purveyor. 6. Only persons employed by the Municipality or contractors a proved by the • Water Purveyor shall install Water Service Connections. 7. The Water Purveyor shall determine the size of the pipes a d fittings to be connected to a water main, but no Water Service connecti n shall be less than 19 mm nominal diameter. The Water Purveyor shall Iso determine the position in the street where the Water Service conn ction may be connected to any water main. 8. (1) Acceptable materials for Water Service connection ipes up to and including 50 mm in internal diameter are as follows: Soft Copper— Type "K" As provided for under Ontario Regulations. (2) Acceptable materials for Water Service connection ipes greater than 50 mm in internal diameter are as follows: • Poly Vinyl Chloride DR-18 or as approved by the W ter Purveyor. 9. All Water Service connections shall be at least 1.5 m bel w the finished grade of the street in which such services are laid or, if t lesser depth, shall be properly protected from freezing to the satisfacti n of the Water Purveyor. PRIVATE WATER SERVICE CONNECTION 10. All Private Water Services shall be Type "K" Soft Coppe or Series 160 Polyethylene, minimum 19 mm diameter. The pipes and fittings used for Private Water Services shall conform in design, quality and all other respects to the standards prescribed by the Ontario Building Code. 11. The installation of all Private Water Services is the responsibility of the • owners of the Premises. 13. The Municipality shall be given at least 48 hours notice by the owner of the Premises when the Private Water Service has been lad and is ready for inspection. All works must be left uncovered and convenient for examination until inspected and approved. No water supply shall be turned on until the work is inspected and approved by the ater Purveyor or the Municipalitys Plumbing Inspector. 14. The owner of any Premises shall maintain in proper order and repair, at his/her own expense, the Private Water Service and its fixtures and appurtenances. 15. Not more than one building shall be supplied from a single) Water Service connection and, for the purposes of this by-law, a semi-dethched dwelling unit shall be deemed to be a separate building. 16. It shall be improper and illegal to permit water supplied to a Premises to be removed from the Premises and used at any location of er than on the • Premises or to be used for any use or benefit of any Pe Qn n other than the owner or occupier of a Premises. 17. Where a building occupies the frontage of a lot located in a residentially - zoned (R1) area of the Municipality and buildings are locat in the rear of the said front building, all such buildings may be supplied m one Water Service connection provided that all said buildings belon to one owner and such owner pays the water rates for all water su plied to such buildings. 18. In all cases where range or steam boilers are supplied ith water, the Municipality shall not be liable for any damage which may result to any Person, Premises or equipment caused by the shutting ff of the water from any water main or service pipe for any purpose wha ever, even in cases where no notice is given or where such damag is caused by uneven water pressure. All service pipe connections to b ilers shall have check valves fixed to prevent water escaping back into the mains and suitable relief valves to relieve excess pressure. • 19. Where the necessary Water Service connection and Privat Water Service have been completely installed to the satisfaction of the N unicipality, and in compliance with the rules and regulations set out in his by-law and Water Meter By-law No. 2004-28, as amended from time to time, and all payments have been received by the Municipality, the water will be turned on by the Water Purveyor or designate and the owner of t e Premises will be held liable for all water charges. 20. There shall be no connection between the Water Servic connection or Private Water Service and any cisterns, wells, privies, privy vaults or cesspools. 21. Existing wells may be maintained provided there is no cro s-connection to the Municipality's Water Works System. 22. All abandoned wells shall be decommissioned by the owners Of the Properties on which they are located, as per Ministry of Enviro mer • Regulations. ../7 7 Amendment to Expanded Service Area Water By-law No. 2005 - 142 23. Every Person who contravenes or causes or permits any c • any of the provisions of this by-law is guilty of an offence p Provincial Offences Act for the Province of Ontario and on liable to a fine of not more than $5,000 exclusive of costs. 24. The Municipality shall endeavor to use reasonable diligenc( regular and uninterrupted service, but does not guarantee water supply or the maintenance of unvaried pressure, and liable for damages to the customer by reason of any failure thereof. 25. All Benefiting Water Landowners of Mandatory Hookups, hether Vacant Land or Occupied, or Optional Hookups, whether V icant Land or Occupied Land, whose Landowner provided written noti ication prior to October 1, 2004 to the Municipality of their intention to pc y capital costs, shall pay Pipeline Capital Charges equal to Year 0 us ng one of the following options as identified in their notification 1. single lump sum payment; 2. two installments; or 3. financing through the Municipality amortized over 15 ye rs 28. All Benefiting Water Landowners of Mandatory Hookups, ether Vacant Land or Occupied, or Optional Hookups, whether V cant Land or Occupied Land, whose Landowner provided written not' cation prior to January 1, 2005 but not before October 1, 2004, shall pay ipeline Capital Charges equal to Year 0 by way of a single lump sum pay ent. 29. All Benefiting Water Landowners of Optional Hookups whc provide written notification on or after January 1, 2005 to the Municipality of their intention to pay capital costs whether or not they connect to the Water Works System shall pay Pipeline Capital Charges in accordance with Schedule B by way of a single lump sum payment. 30. Lots severed on or after January 1, 2005 from a Benefiti g Water Property in existence as of December 31, 2004 shall be required to connect to the Water Works System. Should a well in existence on a Benefiting Water Property which was an Optional Hook-up, be damaged or unable to maintain a su ply of potable • water, connection to the Water Works System shall a mandatory (excluding properties zoned for agricultural use and zoned s Al or A2 as per Municipality of Kincardine By-law 2003-25as amended) The Property Owner shall be required to pay prior to connection of the Private Water Service to the Premises: 1. the Water Capital Charge Premises in acco ance with the charges set out in Schedule "B" 2. the contribution to the meter in the amount in pl ce at the time the plumbing permit is applied for 3. a contribution to the Kincardine Water Reserve F nd of. a) $300 or b) the charge in place at the time when the lumbing permit is applied for whichever is greater. 4. the Fire Capital Charge equal to year "0", pl s CPI as per Schedules "C" and "D" attached to this by-law, u less previously paid. • Payment of these costs will consist of a single lump um payment. 44. (a) Landowners on properties located on Municipal o private roads within the Kincardine Water Treatment Plant Se ice Area who request a supply of Municipal Water, must re uest that the Municipality conduct a survey of all of the landowne on that road. In order for the project to proceed, the survey m st indicate that greater than 60% of the potential benefiting owners are in favour of a supply of municipal water. If this threshold is met it shall then be mandatory for all potential benefiting landowners n that road to connect to the Municipalitys Water Works System. (b) Payment by the Benefiting Landowners on a (road to which municipal Water Services are extended as provide above shall be as follows: • (i) Each benefiting landowner shall pay Charges based upon the date of c construction calculated in accordance N and "D" attached to this by-law, or (ii) Each benefiting owner shall pay a propori Municipaligls actual cost of design and Water Distribution system, plus 10%; whichever is greater. Where installation of Water Servicing is required on pri ate lands, the owners of the land shall grant an easement to the Munici ality in a form satisfactory to the Water Purveyor at the owner's expense. • 46. Future development of lots within the Kincardine Water reatment Plant Expanded Service Area shall comply with Municipality of K ncardine Policy No. PD.1.2 and Policy No. PD.1.3 as amended. 47. (a) Should a situation arise which is not specifically a ressed by this by-law, the Water Purveyor shall have the autho 'ty to make an operational decision in order to facilitate, respond to, consider or dismiss a landowner's request. (b) The landowner may appeal, within 15 days, the ater Purveyor's decision to the Municipality s Public Works Committ e. (c) The Water Purveyor shall endeavor to bring law changes that he/she identifies as des within 90 days of their identification. 48.
