HomeMy WebLinkAbout04 019 zoning RKM amendment e e e e THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW No. 2004 -19 BEING A BY-LAW TO AMEND ZONING BY-LAW N .2003-25, BEING THE COMPREHENSIVE ZONING BY-LAW OR THE MUNICIPALITY OF KINCARDINE KPMG Inc., Trustee in the Estate of RKM Wood Products Ltd , a bankruptcy (Stephen Chemiak) clo McCarthy Tétrault llP (Tara Doyle) lot 30, Concession 4, Municipality of Kincardine (former To nshlp of Bruce) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapte 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws w ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipali of Kincardine has . enacted By-law 2003-25, a zoning by-law enacted under Sect on 34 of the said Planning Act; AND WHEREAS the Corporation of the Municipality of Kincardine d sires to amend By- law 2003-25; NOW THEREFORE the Council of the Corporation of the Munic pality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further amended by changing thereon from 'ACI' to 'ACI-t' the zoning design tion of those lands described Lot 30, Concession 4, Municipality of Kincardine former Township of Bruce), which are outlined on the attached Schedule 'A'. 2. By-law 2003-25, as amended, is hereby further amended by adding the following subsection to Section 27.4 thereof: 27.4.19 Notwithstanding their 'ACI' zoning design tion, those lands identified as 'ACI-t' on Schedule 'A' to this By- aw, shall be used in compliance with the 'ACI' zone provisions con ined in this By-law, excepting, however, that: (i) In addition to those other Permitted Us s in the 'ACI' zone, a 'Non-Effluent Producing Industry' limited to the manufacturing of wood flooring and an ccessory office shall also be a Permitted Use; (Ii) There shall be no more than two (2) rinciple buildings or structures comprising the 'office buil ing' and the 'wood flooring plant' in the ACI-t zone; (Hi) 'Minimum side, front, exterior and rea yard setbacks' and 'maximum lot coverage' shall be as the existed on the date of passing of this By-law. .. ./2 e e e e Page 2 By-Law No. 2004 - 19 Amendment to Comprehensive Zoning By-law Lot 30, Con~ssion 4 This By-law takes effect from the date of passage by Council ar.d comes into force and effect pursuant to the provisions ofthe Planning Act, R.S.O. 1990.
