HomeMy WebLinkAboutTIV 72 08 Licence Transient tra ~ ..,,,,,-- , <' BY - LAW NO. 72-8 of the Village of Tiverton, in the County of Bruce, to licence and regulate transient traders. THE COUNCIL OF THE CORPORATION OF THE VILLAG OF TlVERTON enacts as follows: 1. "Transient trader" includes any person comme cing business who has not resided continuously in the Vill his commencing such business therein, and Tiverton for at least three months next preceding the person whose name has not been entered on or is entered on it for the first time in respect of assessment for the current year and who offers goods, wares or merchandise for sale by auction, conducted by himself or by a licenced auctioneer or otherwise, or who offers goods, wares or merchandise for sale in any other manner. 2. No person shall engage in or carryon trade as a transient trader within the Village of Tiverton with ut first having obtained a licence authorizing him so to do, nd the fee payable for such licence shall be the sum of Thr Dollars ($300.00).~ a-.->f.ß~~ 4/4Ld F'I-'J e Hundred .¿,¿~ .A) 3. The fee payable for such licence by a farme , resident in Ontario, who offers for sale only the produce of is own farm shall be the sum of Five Dollars ($5.00). 4. Every applicant for a transient trader's li ence shall as part of his application for such licence furnish in writing containing a full description of the goo or merchandise that he proposes to sell or offer fo sale under statement such licence. · ; - 2 - 5. Every transient trader shall cause his licen e to be prominently and permanently displayed in his place of business during the full term of which he is carrying on busin ss as a transient trader and in default thereof is guilty of n offense and on summary conviction is liable to a fine of not ess than One Dollar ($1.00) and not more than Ten Dollars ($10 00). 6. Every transient trader who carries on busine s without a licence is guilty of an offense and on summary conv'ction is liable to a fine equal to the licence fee that he hould have paid in addition thereto the sum of not less tha Ten Dollars ($10.00) and not more than Two Hundred Dollar ($200.00) . 7. The sum paid for a transient trader's licenc shall be credited to the person paying it, or to any bona f'de purchaser of the business who carries on the business, on account of taxes payable in respect of the business, nd in respect of real property taxes on the land used for 0 in connection with the business if the land is owned by the person carrying on the business, during the year in ich the licence was issued and five years thereafter. 8. This section does not apply to the sale of he stock I of a bankrupt or an insolvent, within the meaning of ¡any Bankruptcy or Insolvency Act in force in Ontario, no~ to the sale of any stock damages by or by reason of fire, w ich is being sold or disposed of within the Village of Tive ton at the time of the bankruptcy, insolvency or fire, so long s no goods, wares or merchandise are added to such stock. 9. This By-Law does not apply to the sale of a business , ,~ . - 3 - to a bona fide purchaser who continues the business.
