Being a By-law to Establish and Assume Morrison Crescent and Coombs Drive
on Plan 3M98 as Part of the Public Highway System for
The Municipality of Kincardine
Whereas pursuant to the Municipal Act, 2001, S.O. 2001, c. 25 as amended, Section 8 (1) and 9
provide that the powers of a municipality under this or any other Act shall be interpreted broadly so
as to confer broad authority on the municipality to enable the municipality to govern its affairs as it
considers appropriate and to enhance the municipality's ability to respond to municipal issues and
has the capacity, rights, powers and privileges or a natural person for the purpose of exercising its
authority under this or any other Act; and
Whereas the Municipal Act, 2001, S.O. 2001, c. 25, authorizes a Municipality to pass By-laws
regarding Highways; and
Whereas pursuant to s. 31(2) of the Municipal Act, 2001, after January 1, 2003, land may only
become a public highway by virtue of a by-law establishing the highway; and
Whereas the development located at Plan 3M-98 in the Municipality of Kincardine and known as
Stonehaven Phase II and Stonehaven Phase Ill has been completed to the satisfaction of the
Municipality; and
Whereas The Corporation of the Municipality of Kincardine is the owner of the lands described in
Schedule "A" of this By-law; and
Whereas it is the desire of the Council of The Corporation of the Municipality of Kincardine to repeal
By-law 2017-052 as the lands contained in Schedule "A" of the By-law were insufficiently described
for registration purposes in the Bruce County Registry Office (LRO#3); and
Whereas the Council of the Municipality of Kincardine now desires to establish and assume the
public highways created by Plan 3M-98 and located within the Phase II and Phase Ill part of the
development as described further in Schedule "A" of this By-law; now therefore be it
Resolved that the Council of The Corporation of the Municipality of Kincardine Enacts as follows:
1. That By-law 2017-052 is hereby repealed.
2. That the lands described in Schedule "A" to this By-law are hereby established and assumed
by The Municipality of Kincardine as public highways for public use and shall be known as
identified in Schedule "A".
3. That the Mayor and CAO are hereby authorized and directed to execute, on behalf of The
Corporation of the Municipality of Kincardine the necessary documents to fulfill the intent of this
By-law.
4. That this By-law shall come into full force and take effect upon third and final reading thereof.
5. This By-law may be cited as the "Establish and Assume Lands as a Public Highway (Morrison
Crescent, Coombs Drive, Wieck Boulevard, McCullough Crescent) By-law"

Kincardine as a public highway known as "Morrison Crescent".
2. That the lands described as PCL STREETS-1 SEC 3M98; COOMBE DR

CRES PL 3M98; KINCARDINE being all of PIN 33315-0182 (LT) are hereby
established and assumed by the Corporation of the Municipality of
Kincardine as a public highway known as "McCullough Crescent"
