HomeMy WebLinkAbout05 136 Amend Zoning Bylaw 82-08 e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE BY-LAW No. 2005 - 136 BEING A BY-LAW TO AMEND ZONING BY-LAW O. 82'( 8, BEING THE RESTRICTED AREA ZONING BY-LAW FO THE FORMER TOWNSHIP OF KINCARDINE Jonathan & Therese Skinner, Lot 5, Concession 5, Municipality of Kincardine (former Towns ip of Kincardine) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Townsh of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Corporation of the Township of Kincardine ha restructured to now be a part of the Corporation of the Municipality of Kincardine; AND WHEREAS the Council of the Corporation of the Muni ipality of Kincardine desires to amend By-law 82-08; NOW THEREFORE the Council of the Corporation of the Muni ipatity of Kincardine ENACTS as follows: Schedule 'A' to By-law No. 82-08 as amended, is hereby fu her amended by changing thereon from 'A1' to 'A1-69a' and 'A1-69b' the zo ing designation of those lands described as Lot 5, Concession 5, Municipality f Kincardine (former Township of Kincardine) which are outlined on the attached Schedule 'A', 2, By-law No. 82-08, as amended, being the Zoning By-law fo the former Township of Kincardine, is hereby further amended by adding the foil wing paragraph to subsection 9.3 thereof: 1. 9.3.53 (a) Notwithstanding their 'A1' zoning desig ation, those lands delineated as 'A1-69a' on Schedule 'A' to thi By-law may be used for 'Non-farm Residential' purposes in co pliance with the 'A 1 ' zone provisions contained in this By-law, ex pting however, that: (i) The number of livestock units shall be imited to 3.7 livestock . units per hectare, (b) Notwithstanding their 'A1' zoning desi ation, those lands delineated as 'A1-69b' on Schedule 'A' to thi By-law may be used for 'Non-Residential' purposes in complian with the 'A1' zone provisions contained in this By-law, exceptin however, that: (i) The construction of any new resid structures shall be prohibited. buildings and/or .../2 e 3. e e e Page 2 By-law No, 2005 - 136 Amend Zoning By-law 82-08 Lot 5, Concession 5 This By-law takes effect from the date of passage by Council nd comes into force and effect pursuant to the provisions of the Planning A R.S.O. 1990. 4.
