HomeMy WebLinkAbout05 135 Amend Zon Bylaw 2003-25 e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE BY-LAW No. 2005 - 135 BEING A BY-LAW TO AMEND ZONING BY-LAW N .2003-25, BEING THE COMPREHENSIVE ZONING BY-IA FOR THE MUNICIPALITY OF KINCARDINE Jonathan & Therese Skinner, Lot 5, Concession 5, Municipality of Kincardine (former Townsh p of Kincardine) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipal of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Se ion 34 of the said Planning Act; . AND WHEREAS the Council of the Corporation of the Munl Ipality of Kincardine desires to amend By-law 2003-25; NOW THEREFORE the Council of the Corporation of the Muni ¡pality of Kincardine ENACTS as follows: Schedule 'A' to By-law No. 2003-25 as amended, is hereby urther amended by changing thereon from 'A1' to 'A1-a' and 'A1-r' the zoning d signation of those lands described as Lot 5, Concession 5, Municipality of Kin ardine (former Township of Kincardine) which are outlined on the attached Schedule 'A'. 2. By-law No. 2003-25, as amended, being the Comprehensi Zoning By-law for the Municipality of Kincardine, is hereby further amended b adding the fOllowing paragraph to subsection 9.3 thereof: 1. 9.3.14 Notwithstanding their 'A1' zoning desig ation, those lands delineated as 'A1-r' on Schedule 'A' to this B -law may be used for 'Non-farm Lot' purposes In compliance with t e 'A1' zone provisions contained in this By-law, excepting however, hat: 3. (i) The number of livestock units shall be limited to 3.7 livestock units per hectare; and (Ii) Notwithstanding Section 6.4.3.3 L cation of AccessolY Building or Structure the tool shed ay be located in the front yard, as it existed on the date of assage of the By-law. This By-law takes effect from the date of passage by Cou cil and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. .../2 e 4.
