HomeMy WebLinkAbout05 134 Amend 03 25 comp zoning e e' e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE BY-LAW No. 2005 - 134 BEING A BY -LAW TO AMEND ZONING BY-LAW N . 2003·25, BEING THE COMPREHENSIVE ZONING BY-LAW OR THE MUNICIPALITY OF KINCARDINE , Mark & Heather Porter, Part Lot 21, Concession 14, Municipality of Kincardine (former To nship of Bruce) I I I WHEREAS Section 34 of the Planning Act, R.S.O 1990, ChapteJ 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; ~ AND WHEREAS the Council of the Corporation of the Municipal" of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Secti n 34 of the said Planning Act; I AND WHEREAS the Council of the Corporation of the Munici'flity of Kincardine desires to amend By-law 2003-25; i NOW THEREFORE the Council of the Corporation of the MuniCi1ality of Kincardine ENACTS as follows: r , 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby fu her amended by changing thereon from 'A l' to 'M2' and 'A 1-t' the zoning desig ation of those lands described as Part Lot 21, Concession 14, Municipality 0 Kincardine (former Township of Bruce) which are outlined on the attache Schedule 'A'. 2., By-law No. 2003-25, as amended, being the Comprehensive the Municipality of Kincardine, is hereby further amended by paragraph to subsection 9.3 thereof: oning By-law for ding the following 9.3.16 Notwithstanding their 'A1' zoning designa ion, those lands delineated as 'A1-t' on Schedule 'A' to this By-I w may be used for 'Farm Lot' purposes in compliance with the ' l' zone provisions contained in this By-law, excepting however, tha : i) No residential buildings or structures shal be permitted; and ii) The minimum lot area shall be no less t n 32.34 ha (79.92 acres). This By-law takes effect from the date of passage by Council nd comes into force and effect pursuant to the provisions of the Planning A R.S.O. 1990. 4. This By-law may be cited as the 'Amendment to Comprehens ve Zoning By-law 2003-25, (Part Lot 21, Concession 14, Municipality of Kincard ne (former Township of Bruce», By-law".
