BY-LAW
No. 2005 -131
BEING A BY·LAW TO AMEND ZONING BY-LAW N .2003-25,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE
MUNICIPALITY OF KINCARDINE

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapte 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws wh ch comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipali of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Secti n 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Munici lity of Kincardine
desires to amend By-law 2003-25;
NOW THEREFORE the Council of the Corporation of the Munici ality of Kincardine
ENACTS as follows:
1.
Schedule 'A'to By-law No. 2003-25 as amended, is hereby fu her amended by
changing thereon from 'A2' to 'A2-a' and 'A2-m' the zoning de ignation of those
lands described as Part Lots 44,45 and 46, Concession 'A', unicipality of
Kincardine (fonner Township of Kincardine) which are outline on the attached
Schedule 'A'.
2. By-law No. 2003-25, as amended, being the Comprehensive oning By-law for
the Municipality of Kincardine, is hereby further amended by dding the following
paragraph to subsection 10.3 thereof:
10.3.11
Notwithstanding their 'A2' zoning designa ion, those lands
delineated as 'A2-m' on Schedule 'A' to this By-I w may be used for
'Non-fann Lot' purposes in compliance with the' , zone provisions
contained in this By-law, excepting however, tha :
(i) The number of livestock units shall be Ii ted to 3.7 livestock
units per hectare; and
(ii) The minimum rear yard setback shall be no less than 2.0 m
as existed for the accessory structur on the date of
passage of the By-law.
3. This By-law takes effect from the date of passage by Council nd comes into
force and effect pursuant to the provisions of the Planning A ,R.S.O. 1990.

Read a FIRST, SECOND and a THIRD time and FINALLY PASSED this 10th day of
August 2005.
