HomeMy WebLinkAbout05 130 Amend 03 25 lts 31,73 e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE BY-LAW No. 2005 - 130 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 2003-25, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF KINCARDINE Donald and Norma Ruthven c/o Ron David on, East Part Lot 1, Concession 12, Municipality of Kincardine (fo er Township of Kincardine); and Part Lot 31, Plan 76, and Part Lots 73 and 74 King, Plan 210, Municipality of Kincardine (former Village of Tivert n) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws w ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipali of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Sect on 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Munici ality of Kincardine desires to amend By-law 2003-25; i NOW THEREFORE the Council of the Corporation of the Munic .,ality of Kincardine ENACTS as follows: r 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby f rther amended by changing thereon from 'A1' and 'PO' to 'A1-u' and 'R1-aa' the zoning designation of those lands described as East Part Lot 1, Concession 12, unicipality of Kincardine (former Township of Kincardine), and Part Lot 31, Plan 76, and Part Lots 73 and 74 King, Plan 210, Municipality of Kincardine (fo er Village of Tiverton) which are outlined on the attached Schedule 'A'. 2. . By-law No. 2003-25, as amended, being the Comprehensive lOning By-law for the Municipality of Kincardine, is hereby further amended by fdding the following paragraph to subsection 9.3 thereof: i 9.3.16 Notwithstanding their 'A1' zoning designa ion, those lands delineated as 'A1-u' on Schedule 'A' to this By-I w may be used for 'Farm Lot' purposes in compliance with the' l' zone provisions contained in this By-law, excepting however, th : (i) The minimum lot area shall be no less th n 13.11 ha; (ii) The minimum lot frontage shall be no les than 39.62 m; (iii) For the purposes of this By-law, the 10 frontage shall be defined as those lands abutting James S eet. 3. By-law No. 2003-25, as amended, being the Comprehensive oning By-law for the Municipality of Kincardine, is hereby further amended by ding the following paragraph to subsection 12.3 thereof: .../2 e e e e Page 2 By-law No. 2005 - 130 Amend Zoning By-law 2003-25 East Part Lot 1, Conces ion 12 Notwithstanding their 'R1' zoning designa ion, those lands delineated as 'R1-aa' on Schedule 'A' to this y-Iaw may be used for 'Residential' purposes in compliance h the 'R1' zone provisions contained in this By-law, excepting h wever, that: 12.3.27 (i) The setbacks for all buildings and struct res shall be no less than as they existed as of the date of pa ing of this By-law; (ii) The minimum lot area shall be no less th n 3.76 ha; (iii) The minimum lot frontage shall be no les than 12.19 m; (iv) For the purposes of this By-law, the I t frontage shall be defined as those lands abutting King St t. 3. This By-law takes effect from the date of passage by Council nd comes into force and effect pursuant to the provisions of the Planning A ,R.S.O. 1990. This By-law may be cited as the "Amendment to Comprehen ive Zoning By-law 2003-25, (East Part Lot 1, Concession 12, Municipality of Kin rdine (former Township of Kincardine), and Part Lot 31, Plan 76, and Part ots 73 and 74 King, Plan 210, Municipality of Kincardine (former Village of Tiverto », By-law".
