HomeMy WebLinkAbout05 129 Amend 82-08 restricted a e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE BY-LAW No. 2005 - 129 BEING A BY·LAW TO AMEND ZONING BY-LAW 0.82-08, BEING THE RESTRICTED AREA ZONING BY-LAW FO THE FORMER TOWNSHIP OF KINCARDINE Donald and Norma Ruthven clo Ron Davids n, East Part Lot 1, Concession 12, Municipality of Kincardine (fo r Township of Kincardine) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapte 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws wh ch comply with an approved official plan; . AND WHEREAS the Council of the Corporation of the Townshi of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 f the said Planning Act; AND WHEREAS the Corporation of the Township of Kincardine has restructured to now be a part of the Corporation of the Municipality of Kincardine; AND WHEREAS the Council of the Corporation of the Munici ality of Kincardine desires to amend By-law 82-08; NOW THEREFORE the Council of the Corporation of the Munici ality of Kincardine ENACTS as follows: Schedule 'A' to By-law No. 82-08 as amended, is hereby furt er amended by changing thereon from 'A1' to 'A1·72' the zoning designation fthose lands described as East Part Lot 1, Concession 12, Municipality of incardine (former Township of Kincardine) which are outlined on the attached chedule 'A'. 2. By-law No. 82-08, as amended, being the Zoning By-law for e former Township of Kincardine, is hereby further amended by adding the folio ing paragraph to subsection 9.3 thereof: 1. 9.3.56 Notwithstanding their 'A1' zoning design tion, those lands delineated as 'A1-72' on Schedule 'A' to this y-Iaw may be used for 'Non-Residential' purposes in compliance with the 'A1' zone provisions contained in this By-law, excepting h wever, that: (i) The minimum lot area shall be no less t an 13.11 ha; (ii) The minimum lot frontage shall be no Ie s than 39.62 m; (iii) For the purposes of this By-law, the I t frontage shall be defined as those lands abutting James treet. 3. This By-law takes effect from the date of passage by Counci and comes into force and effect pursuant to the provisions of the Planning A ,R.S.O. 1990. .../2 e 4.
