HomeMy WebLinkAbout05 128 Amend zon 03-25, lts 2,3 M ENDED/REPEALED BY w-No: he) , 1P) DATED�'�: , THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KB7 t ,. y it ♦ � , �N�c'PAUT Y Of KMCPP O BY -LAW No. 2005 —128 BEING A BY -LAW TO AMEND ZONING BY -LAW NO. 2003-25, BEING THE COMPREHENSIVE ZONING BY -LAW FOR THE MUNICIPALITY OF KINCARDINE Reid's Heritage Group (Jim Dodd) c/o GSP Group Inc., Part of Lots 2 and 3, Concession 1, South of Durham Road, Municipality of Kincardine (former Township of Kincardine) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by -laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has enacted By -law 2003 -25, a zoning by -law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By -law 2003 -25; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By -law No. 2003 -25 as amended, is hereby further amended by changing thereon from `C6 -d', `PD' and `EP' to `R2', `R3', `C6 -g', `C6', `OS', `PD' and revised `EP' the zoning designation of those lands described as Part of Lots 2 and 3, Concession 1, South of Durham Road, Municipality of Kincardine (former Township of Kincardine) as outlined on the attached Schedule 'A'. 2. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By -law for the Municipality of Kincardine, is hereby further amended by adding the following paragraph to subsection 22.5 thereof: 22.5.7 Notwithstanding their `C6' zoning designation, those lands delineated as `C6 -g' on Schedule `A' to this By -law may be used for `Business Park' purposes in compliance with the `C6' zone provisions contained in this By- law, excepting however, that: (i) Notwithstanding Section 6.18 `Planting Strip /Privacy Fence' of this By- law and Section 22.4.2.1 `Planting Strip (Business Park)', a `Planting Strip' a minimum of 30 metres in width and stocked with mature coniferous and deciduous trees shall be established and maintained along the boundary with the `C6 -e Business Park Special' zone; and • (ii) Section 22.4.2.1 Planting Strip [Additional Provisions - Business Park], shall not apply. .../2 e 3. e e e Page 2 By-law No. 2005 - 128 Amend Zoning By-law 2003-25 Part Lots 2 and 3, Concessi n 1 SDR This By-law takes effect from the date of passage by Council nd comes into force and effect pursuant to the provisions of the Planning Act R.S.O. 1990 and subject to Municipality of Kincardine Official Plan amendment 10/05.22 for the subject land being in force and effect pursuant to the provisio s of the Planning Act, R.S.O. 1990. . 4.
