No. 2005 - 127
A BY-LAW TO ADOPT AMENDMENT NO.1
TO THE TOWN OF KINCARDINE OFFICIAL P
WHEREAS The Council of the Municipality of Kincardine, pursua t to Section 17 of the
Planning Act, R.S.O. 1990 enacts as follows::
1. That Amendment No.1 0 to the Town of Kincardine Officia Plan, a copy of which
is attached to and forms part of this By-law, is hereby adop ed.
2. That the Clerk is hereby directed to forward the adopte amendment together
with the necessary supporting documentation to the Co nty of Bruce for final
approval.
3. This By-law takes effect from the date of passage by Cou iI and comes into
force and effect pursuant to the provisions of the Planning ct, R.S.O. 1990.
4. This By-law may be cited as the "Adopt Amendment No.1 to the Town of
Kincardine Official Plan By-law'.
Read a FIRST, SECOND and a THIRD time and FINALLY PAS
August 2005.

PART B - THE AMENDMENT
INTRODUCTORY STATEMENT
All of this part of the document entitled "Part B - The Amendment" and consisting of the
following text, and attached map designated as Schedule "A", co stitutes Amendment
No. 10 to the Town of Kincardine Official Plan.
DETAILS OF THE AMENDMENT
The Town of Kincardine Official Plan is proposed to be amended
(1) 'Schedule 'A' to the Town of Kincardine Official Plan is hereby amended by
changing the land use designation on lands described as Part of Lots 2 and 3,
Concession 1, South of Durham Road, Municipality Kincardine (former
Township of Kincardine) from 'Business Park', 'Busine s Park Special' and
'Natural Environment (Note 1) to 'Residential', 'Business ark', revised 'Natural
Environment (Note 1), 'Future Development' and 'Open Sp ce', as outlined in the
attached Schedule "A".
(2) Subsection Section D3.5.2(n) Policies - Business Park (Industrial) is hereby
deleted in its entirety and replaced With the following:
n) Notwithstanding the above policies, those lands i entified as 'Business
Park Special' may be used in accordance with the' esidential' policies of
this Plan found in Section D1. These lands a recognized as being
occupied by a residential use [historic log cabin] a d may continue to be
used for residential purposes until such time as th property is converted
to a use in accordance with the above noted 'Busin ss Park' policies.
The lands within the 'Business Park Special' desig tion include the lands
described as Part 1, Reference Plan 3R..3887, Pa 1, Plan 3R-6579, Part
Lot 2, Concession 1 SDR, former Town of Kincardi e.
A 30 metre 'Buffer Area' abutting the eastem, w tem and southem lot
lines of the above noted lot shall be required and i plemented through the
Comprehensive Zoning By-law.
The 30 metre 'Buffer Area' shall be a planting st p stocked with mature
coniferous and deciduous trees. It is the intent f this Plan to limit the
impact on the 'Business Park Special' area by future commercial or
industrial development. Development proposals butting this area shall
incorporate into their site plans measures to mi imize impacts on this
property.
