HomeMy WebLinkAbout23 006 Amendment to Comprehensive Zoning By-law 2003-25, 708 Concession 2 (Dalton) By-lawTHE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW No. 2023 – 006 Being a By-law to Amend Zoning By-law No. 2003-25, Being the Comprehensive Zoning By-law for the Municipality of Kincardine Ann Elizabeth Dalton and Terrance John Dalton 708 Concession 2 Municipality of Kincardine (Bruce Township) Whereas Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; and Whereas the Council of the Corporation of the Municipality of Kincardine has enacted By-law 2003 - 25, a zoning by-law enacted under Section 34 of the said Planning Act; and Whereas the Council of the Corporation of the Municipality of Kincardine desires to amend By-law 2003-25; now therefore be it Resolved that the Council of the Corporation of the Municipality of Kincardine Enacts as follows: 1.Schedule 'A' to By-law No. 2003-25 as amended, is hereby further amended by changing the zoning on the severed lands from ‘General Agriculture (A1)’ zone to ‘General Agriculture Special (A1-hj)’ zone and the zoning on the balance of the farmlands from ‘General Agriculture (A1)’ zone and ‘Environmental Protection (EP)’ zone to ‘General Agriculture Special (A1-hk)’ zone and ‘Environmental Protection (EP)’ zone on those lands described as BRUCE CON 3 PT LOTS 17 AND;18 Municipality of Kincardine (Bruce Township) as outlined on the attached Schedule ‘A’. 2.By-law No. 2003 - 25 as amended, is hereby further amended by adding the following subsections to Section 9.5 Special Provisions thereof: On lands zoned A1-hj Notwithstanding Section 9.2 Zone Provisions – Non-Farm Lot, on lands zoned ‘A1-hj’, the following applies: a.The minimum lot frontage shall be no less than 10.75 m. b. The existing barn shall not be used as a livestock facility. On lands zoned A1-hk Notwithstanding Section 9.1 Permitted Uses, on lands zoned ‘A1-hk’, the following applies: a.The construction of any new residential buildings and / or structures shall be prohibited. 3.This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990.
