BEING A BY ·LAW TO AMEND ZONING BY-LAW NO. 1988-1,
BEING THE COMPREHENSIVE ZONING BY-LÄ FOR THE
TOWN OF KINCARDINE
INGO AND LORI GOLLAN, PART OF PARK LOT 35
MUNICIPALITY OF KINCARDINE (FORMER TOWN OF
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chap er 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws hich comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Town of Ki cardine has enacted
By-law 1988-1, a zoning by-law enacted under Section 34 of the s id Planning Act;
AND WHEREAS the Corporation of the Town of Kincardine has r structured to now be
a part of the Corporation of the Municipality of Kincardine;
AND WHEREAS the Corporation of the Municipality of Kincardine desires to amend By-
law 1988-1;
NOW THEREFORE the Council of the Corporation of the Mun cipality of Kincardine
ENACTS as follows:
1.
Schedule 'A'to By-law No. 1988-1 as amended, is hereby ~ rther amended by
changing thereon from 'R1' to 'R1-16' and 'H', the zoning d signation of those
lands described as Part of Park Lot 35 on Plan 4, Municipal ty of Kincardine
(former Town of Kincardine), which are outlined on the atta hed Schedule 'A'.
2. By-law 1988-1, as amended, is hereby further amended b adding the following
subsection to Section 5.1.4 thereof:
5.1.4.19
Notwithstanding their 'R1' zoning desig ation, those lands
described as Part of Park Lot 35 on PI n 4, Municipality of
Kincardine (former Town of Kincardine) and dentified by the zone
symbol 'R1-16' on Schedule 'A' to this By-I w, shall be used in
compliance with the 'R1' zone provisions co tained in this By-law,
excepting, however, that:
(i) For the purpose of subsection '4.8 rontage on a Street',
Cedar Lane shall be considered to be n "improved street".
3.
This By-law takes effect from the date of passage by Coun iI and comes into
force and effect pursuant to the provisions of the Planning ct, R.S.O. 1990.
