THE CORPORATION OF THE MUNICIPALITY OF KlNCA INE
BY-LAW
NO. 2005 -114
BEING A BY-LAW TO AUTHORIZE THE PURCHASE OF P YGROUND
EQUIPMENT FOR MUNICIPAliTY OF KINCARDINE ARKS
(PARCS Ltd.)
WHEREAS the Municipal Act, 2001, S.D. 2001, c. 25 Section 1 (2) provides that
lower-tier municipalities may pass by~laws within the sphere of jurisdiction of
culture, parks, recreation and heritage;
AND WHEREAS pursuant to the said Municipal Act, Sections 8 and 9 (1) provide
municipalities with the powers of a natural person to enable th m to govem their
affairs as they consider appropriate and to enhance their abi ity to respond to
municipal issues;
AND WHEREAS the Council for The Corporation of the Municip lity of Kincardine
deems it necessary to purchase playground equipment for va 'ous parks within
the municipality;
AND WHEREAS the Council for The Corporation of the Munici lity of Kincardine
deems it expedient to accept the tender of Pares Ltd. i the amount of
$41,564.20, plus all applicable taxes, for the supply and installa ion of playground
equipment as detailed in specifications prepared by the Recreat on Committee;
AND WHEREAS during the 2005 capital budget deliberations, $100,000.00 was
budgeted for the purchase of new playground equipment;
AND WHEREAS the Council for the Corporation of the Munici lity of Kincardine
has determined to purchase playground equipment from Pares td. on a unit basis
up to the allocated budget of $100,000.00;
NOW THEREFORE the Council for The Corporation of t e Municipality of
Kincardine ENACTS as follows:
That the tender of PARCS Ltd., for the supply d installation of
playground equipment on a unit basis, up to the all cated playground
equipment budget limit of $100,000, including taxes, be erebyaccepted.
That the Mayor and CAD be hereby authorized to sig , on behalf of the
Council for The Corporation of the Municipality of Kinca ine any contracts
and other documents required to authorize such purcha es.

3.
That the Recreational Services Committee is hereby aut orized to identify
the location and type of equipment required by various parks throughout
the municipality.
4. This by-law shall come into full force and effect upon its fi al passage.
5. This by-law may be cited as the ·Playground Equipme t (2005) Tender
Acceptance By-law".
