Receiver Manager of Bluewater Fibre Inc. c/o aul Bennett, Part Lot 30, Concession 5, Municipality of Kincardine (form r Township of Bruce) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the Councils of Municipalities to enact and amend zoning by-Ia s which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipal of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under S ction 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipal ty of Kincardine desires to amend By-law 2003-25; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further amended by changing thereon from 'ACI-s' to 'ACI- -h' the zoning designation of those lands described as Part Lot 30, Concession 5, Municipality of Kincardine (former Township of Bruce), wh ch are outlined on the attached Schedule 'A'. 2. By-law No. 2003-25, as amended, being the Comprehen ive Zoning By- law for the Municipality of Kincardine, is hereby furth r amended by adding the follciwing paragraph to subsection 27.4 thereof: 27.4.18 Notwithstanding their 'ACI-s' zoning designati n, those lands delineated as 'ACI-s-h' on Schedule 'A' to this By-Ia may be used for 'Agricultural Commercial/Industrial' purposes in ompliance with the 'ACI' zone provisions contained in this By aw, excepting however, that: . . ./2 e Page 2 By-law No. 2005 - 111 Amendment to Comprehensive Zoning By-law Part Lot 30, Municipality of Kincardine (former Township of Bru (i) The permitted non-residential uses shall be limi ed to: a. 'Bulk Sales Establishment - Agric tural'; b. 'Farm Implement Establishment'; c. 'Feed Mill & Elevator'; d. 'Food Processing - Primary'; e. 'Industry - Non-Effluent Produ ing limited to packaging (Le. bagging, boxing, crating, shrink wrapping, etc.) woodworking, 0 amenting and assembly'; f. 'Nursery'; g. 'Warehouse excluding a 'Transpo Depot'; (ii) The lands shall be subject to Site Plan Control; (iii) The 'H' provision may be removed onc the following conditions have been met: e (1) A statement from a certified engineer stating th t all floor drains which may become contaminated with oils, s Ivents or other similar liquid/materials are not directly c nnected to a new/existing domestic waste treatment system on the property is provided; and (2) A statement from a certified engineer stating th t all floor drains which may become contaminated with oils, s Ivents or other similar liquid/materials have been connect d to a total retention/separator tank or similar engine ed system is provided; and (3) A statement from a certified engineer stati g that a total retention/separator tank or a similar engineer system which separates oils, fuels. lubricants, cleaners & s Ivents etc. and stores all separated contaminants has been nstalled and is functioning according to its design specificati ns is provided; and e (4) A current contract with a MOE certified carrier ngaged for the disposal of materials from the total retention/s parator tank or a similar engineered system is provided; and (5) A Site Plan Control Agreement has been re istered on title; and (6) A 'Spill Contingency Plan' shall be prepared 0 lining the ways and means by which spills are to be prevente , managed and remediated. 3.
