HomeMy WebLinkAbout05 108 Amend zon by-law 82-08 e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE No. 2005 - 10S BEING A BY-LAW TO AMEND ZONING BY-LAW NO S2..oS, BEING THE RESTRICTED AREA ZONING BY·LAW FOR T E FORMER TOWNSHIP OF KINCARDINE Joseph & Clara Ebersol, Lot 11, Concession 12, Municipality of Kincardine (fonner Township of Kin ardlne) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chap r 13 authorizes the Councils of Municipalities to enact and amend zoning by-Ia s which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Towns ip of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Secti n 34 of the said Planning Act; AND WHEREAS the Corporation of the Township of Kincardine as restructured to now be a part of the Corporation of the Municipality of Kincard ne; AND WHEREAS the Council of the Corporation of the Municipal ty of Kincardine desires to amend By-law 82-08; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 82-08 as amended, is hereby rther amended by changing thereon from 'Ar to 'A1-70' the zoning desi nation of those lands described as Lot 11, Concession 12, Municipal" of Kincardine (former Township of Kincardine), which are outlined the attached Schedule 'A'. 2. By-law No. 82-08, as amended, being the Comprehensiv Zoning By-law for the former Township of Kincardine, is hereby furth r amended by adding the following paragraph to subsection 9.3 thereof: 9.3.54 Notwithstanding their 'A1' zoning designation, those lands delineated as 'A1-70' on Schedule 'A' to this By-Ia may be used for 'General Agriculture' purposes in compliance wi the 'A1' zone provisions contained in this By-law, excepting howe er, that: (i) Notwithstanding Section 8.1 Accessol}' Detach d Dwellings, a second 'Accessory Detached Dwelling' may be e cted; and (ii) The second 'Accessory Detached Dwelli g' shall be constructed/located within 18.3 metres (60 feet) of the existing dwelling as it existed as of the date of passage 0 this By-law; - (iii) The second 'Accessory Detached Dwelling' shal be exclusively for the use of person's - employedlworking on the ubject lands. .../2 e e e e Page 2 By-law No. 2005 - 108 Amend Zoning By-law Lot 11, Concession 12, Municipality f Kincardine (former Township of Kincardine) 3. This By-law takes effect from the date of passage by C uncil and comes into force and effect pursuant to the provisions of the PI nning Act, R.S.O. 1990. 4. This By-law may be cited as the "Amendment to Comp ehensive Zoning By-law 82-08, (Lot 11, Concession 12, MUnicipality of incardine (former Township of Kincardine», By-law".
