HomeMy WebLinkAbout05 107 Amend zon by-law 2003-25 AD/REPEALED BY 8 Jh C)hP DATED tat ( I (D )-0 THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT� okAU MC P Q� \a�• BY -LAW No. 2005 —107 BEING A BY -LAW TO AMEND ZONING BY -LAW NO. 2003 -25, BEING THE COMPREHENSIVE ZONING BY -LAW FOR THE MUNICIPALITY OF KINCARDINE Reid's Heritage Group (Jim Dodd) c/o GSP Group Inc., Part Lot 2, Concession 1 SDR (being Parts 1, 2 and 3 on RP 3R -6657; subject to ROW), Municipality of Kincardine (former Town of Kincardine) • WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by -laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has enacted By -law 2003 -25, a zoning by -law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By -law 2003 -25; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By -law No. 2003 -25 as amended, is hereby further amended by changing thereon from `PD' to `C6 -f -h' the zoning designation of those lands described as Part Lot 2, Concession 1 SDR (being Parts 1, 2 and 3 on RP 3R -6657; subject to ROW), Municipality of Kincardine • (former Town of Kincardine), which are outlined on the attached Schedule 'A'. 2. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By- law for the Municipality of Kincardine, is hereby further amended by adding the following paragraph to subsection 22.5 thereof: 22.5.6 Notwithstanding their `C6' zoning designation, those lands delineated as `C6 -f -h' on Schedule `A' to this By -law may be used for `Business Park' purposes in compliance with the `C6' zone provisions contained in this By -law, excepting however, that: (i) Notwithstanding Section 22.4.2 Planting Strip, a `Planting Strip' shall be established, a minimum width of 30 metres and stocked with 3 rows of trees a minimum height of 3.0 m, along the west lot line abutting the residential use. • (ii) The `h — Holding' provision may be removed once the following conditions have been met: a. A Stormwater Management Plan submitted to the satisfaction of th Saugeen Valley Conservation Authority, the Minis ry of Transportation and the municipal . c. A letter from the Ministry of Tran portation, that all of their conditions have been sati tied, has been submitted to the Chief Building 0 Icial for the municipality. 3. This By-law takes effect from the date of passage by Co ncil and comes into force and effect pursuant to the provisions of the Pia ning Act, R.S.O. 1990. 4. This By-law may be cited as the "Amendment to Compre ensive Zoning By-law 2003-25, (Part Lot 2, Concession 1 SDR (being P rts 1, 2 and 3 on RP 3R-6657; subject to ROW), Municipality of Kincardin (former Town of Kincardine», By-law".
