THE CORPORATION OF TIlE MUNICIPALITY OF KINCA DINE
BY-LAW
NO. 2005 -103
BEING A BY-LAW TO DETERMINE A DEADLINE FOR THE STAlLATION
OF WATER METERS WITHIN THE MUNICIPALITY OF K NCARDINE
WHEREAS the Council for the Corporation of the Municipa'ty of Kincardine
enacted rules and regulations for the installation, repair, mainte ance and access
to water meters in the Municipality of Kincardine with the pass ge of By-law No.
2004 - 28;
AND WHEREAS Section 2 of By-law No. 2004 - 28 stat that "all water
supplied through existing and new private water services for se on premises
connected to any of the municipally owned water systems sh I pass through a
meter owned by the Municipality for use upon such premis s and the rates
charged shall be those fixed from time to time by the Municipali ";
AND WHEREAS Section 11 (g) of By-law No. 2004 - 28 state "if it is physically
possible for an owner to have a water meter installed, but refus s to allow one to
be installed, the consumer will be charged four times (4 tim s) the minimum
charge for each billing period";
AND WHEREAS Sections 8 and 9 (1) of the Municipal Act, 200 ,5.0. 2001, c.
25, as amended, provides municipalities with powers of a natur I person to
enable them to govem their affairs as they consider appropriate and to enhance
their ability to respond to municipal issues;
AND WHEREAS it has been determined that a deadline of Oct er 15, 2005
should be set as the deadline for the installation of water mete in all premises
being supplied with municipal water;
NOW THEREFORE the Council for The Corporation of the Mun cipality of
Kincardine ENACTS as follows:
1. That the deadline for the installation of water meters in th se premises
being supplied with municipal water, as determined by B -law No. 2004 -
28, be set at October 15, 2005.
2. That effective October 17, 2005, those property owners hose properties
are non-compliant with the regulations of Section 2 and 1 (g) of By-law
No. 2004 - 28 be notified that effective January 1, 2006, he invoiced rate
for water will be four times the minimum as set in By-law o. 2005 - 047.
3.
This by-law shall come into full force and effect upon its al passing.
