NO. 2004 - 09
BEING A BY·LAW TO DESIGNATE THE HOME OF MARY ELI
AT 338 DURHAM MARKET SOUTH, MUNICIPALITY OF KI
(FORMER TOWN OF KINCARDINE) AS BEING OF HIST
ARCHITECTURAL VALUE

WHEREAS the Ontario Heritage Act, 1990, Chapter 0.18, as amended,
authorizes the Council of a municipality to enact by-laws to designate real
property, including all the building and structures thereon, to b of historic or
architectural value and interest;
AND WHEREAS the Council of the Municipality of Kincardine h s caused to be
served on the owner of the lands and premises known as the home of Mary
Elizabeth Shaw, 338 Durham Market, South, Municipality of Kinc rdine and upon
The Ontario Heritage Foundation, notices of intention to so designate the
aforesaid property and has caused such notice of intention to s designate the
aforesaid real property to be published in a newspaper having ge eral circulation
in the Municipality;
AND WHEREAS the reasons for designation are set out i Schedule "B"
attached hereto;
NOW THEREFORE the Council of the Corporation of the Municipality of
Kincardine ENACTS as follows:
There is designated as being of architectural value and i terest the real
property more particularly described in Schedule "A" heret ,known as the
home of Mary Elizabeth Shaw, 338 Durham Market South Municipality of
Kincardine, Ontario.
2. The Clerk is hereby authorized to cause of copy of thi by-law to be
registered against the property described in Schedule " " hereto in the
proper land registry office.

3. The Clerk is hereby authorized to cause a copy of the by-I w to be served
upon the owner of the aforesaid property and upon The ntario Heritage
Foundation and to cause notice of this by-law to be published in a
newspaper having general circulation in the Municipality of Kincardine.
4. This by-law shall come into full force and effect upon its tin I passing.
5. This by-law may be cited as the "338 Durham Market Sout Heritage
Designation By-law·.

half of an acre more or less. Description as per Instrument 246211.

SCHEDULE "B"
This house has a long standing historical and architectural im ortance to the
Municipality: built by one of the major early builders in incardine, T.C.
Rooklidge, in 1876 or 1877, this Victorian house has been hom to members of
the Farley family continuously since 1907. Robert Madden, the manager of the
pork factory which was located next door, lived here from 1877 - 1907, when Mr.
Richard Farley bought the house in order to be close to his I mber business
located at 312 Durham Market South.
While significant changes have been made to the Victorian b ilding over the
years, of particular note is the Rose, Shamrock and Thistle patter in windows on
the front and west sides of the house. The grey brick and pink ortar are most
unusual for the area. The former carriage house has given way 0 a rebuilt barn
on the original foundation. Exclusions from designation ar the replaced
windows, the front porch and the addition on the rear of the hous .
