BEING A BY-LAW TO AMEND RATES AND FEES FOR sOLlq WASTE
MANAGEMENT SERVICES PERFORMED BY THE MUNICIPALITY Of KINCARDINE
WHEREAS Section 391 of the Municipal Act, 2001, S.O. 2001, c. 25, a~ amended,
provides authority for municipalities to pass by-laws imposing fees or chiarges on any
class of persons for services provided by the municipality; I
AND WHEREAS O.Reg. 244/02, s. 12 (2) provides that the amount of f 3es or charges
for the use of solid waste management shall not exceed the cost of providing the solid
waste management; i
AND WHEREAS Sections 8 and 9 (1) of the Municipal Act, 2001, S.O. ~001, c. 25
provides municipalities with powers of a natural person to enable them fo govem their
affairs as they consider appropriate under this or any other Act; .
AND WHEREAS the Council for the Corporation of the Municipality of Kincardine deems
it advisable to amend the existing landfill site fees as set in Schedule "~" of Municipality
of Kincardine By-Law No. 2004-186; .

NOW THEREFORE the Council for The Corporation of the Municipalitylof Kincardine
ENACTS as follows: ,

1. Schedule "A" of By-law No. 2004-186 be hereby rescinded and ~ePlaced with the
attached Schedule "A". .

This by-law shall supercede any previous by-law inconsistent with the provisions
contained herein. ,
3.
,
That this by-law shall come into full force and effect on July 7, ~005.
,
That this By-Law shall be known as the "Amendment to Consolidated Solid
Waste Management Rates and Fees By-law No. 2004-186 By-I~w".
