HomeMy WebLinkAbout05 091 agree RIDE 05-06 e e e e THE CORPORATION OF THE MUNICIPALITY OF KINC RDINE BY-LAW NO. 2005 - 091 BEING A BY-LAW TO AUTHORIZE THE SIG ING OF AN AGREEMENT WITH HER MAJESTY THE QU N IN RIGHT OF THE PROVINCE OF ONTARIO AS REPRES NTED BY THE MINISTRY OF COMMUNITY SAFETY AND C RRECTIONAL SERVICES WHEREAS Section 22(1) of the Municipal Act, 2001, S. . 2001, c.25, as amended, allows for municipalities to provide a system that' would otherwise not have power to provide within the municipality, if it does so i accordance with an agreement with the Province of Ontario under a progra established and administered by the Province of Ontario; AND WHEREAS Her Majesty the Queen in Right of the Prov ce of Ontario as represented by The Ministry of Community Safety and Correcti nal Services has established the R.I.D.E. Grant Program to provide grants t municipal police services and Ontario Provincial Police (OPP) municipal co ract locations to offset staff costs of participating in the R.I.D.E. program's sobri ty checks; AND WHEREAS the Council for The Municipality of Kincardin has entered into an Agreement with the Ministry of Community Safety and Co ectional Services to have police services provided by the OPP; AND WHEREAS the South Bruce OPP requested funding for he R.I.D.E. Grant Program; AND WHEREAS the Ministry has approved the R.I.D.E. grant a plication; NOW THEREFORE the Council for The Corporation of th Municipality of Kincardine ENACTS as follows: 1. That the Corporation of the Municipality of Kincardine enter i to an agreement with Her Majesty the Queen in Right of the Province of Onta '0; 2. Program results required by Schedule D - 2005/2006 RIDE GRANT M NTHLY STATISTICS will be reported on a monthly basis including nil reports. In-year and en of year financial reporting is required as per timeline noted in Schedule A - TERMS OF RE RENCE, Schedule B - 200512006 RIDE GRANT INTERIM FINANCIAL STATUS PORT and Schedule C- 200512006 FINAL REPORT ON RIDE GRANT PROGRAM 4,2 The Ministry will pay the Grantee following the receipt ofProjec records stipulated in Schedule A - TERMS OF REFERENCE 200512006 RIDE GRANT PR GRAM of this Agreement, which are records of activities that are, in whole or part, outlined' Schedule E - 2005/2006 RIDE GRANT APPLICATION, the Grantee's Application. e Grantee agrees that payment by the Ministry for such activities is premised on the Grantee's hievement of specific measurable results directly related to the stated project objectiv Article 5 Termination 5.1 The Grantee agrees that the award of the Grant is based upon the' ormation supplied to the Ministry by the Grantee, and that the Grant received fÌ'Om the .. stry is to be used only for the purposes described in this Agreement. If any of the information pplied is false, if funds are not used for approved purposes, or if the terms and conditions of this agreement are breached by the Grantee, this Agreement may be terminated by the Ministry. If e Ministry terminates this Agreement, any and all amounts of the Grant paid under this A ement shall be repaid to the Ministry. Upon termination by the Ministry, all obligations of th Ministry, including commitment to pay the Grant, shall cease immediately. Page 2 ·- . . Article 6 Intellectual Pronertv 6,1 The Grantee represents and warrants that it shall not, in respect 0 the Project administered under this Agreement, infringe upon or violate any patent, copyright, tr e mark, trade secret or any other right of any third party, and shall not be libellous or oth se unlawful. Article 7 Annlicable Laws 7.1 The Grantee represents and warrants that it shall comply with all edera1, provincial and municipal laws, regulations and orders in existence on the date 0 execution of this Agreement and which come into existence during the tenn of this Agreemen including but not limited to the Human Rights Code and the Municipal Freedom of Information nd Protection of Privacy Act as they pertain to the Project administered under this Agreement. e Grantee shall be responsible for obtaining any permits or licences required for the perfonnanc of their responsibilities under this Agreement. Article 8 Further Grants 8.1 It is agreed and understood that the provision of the Grant in no ay commits the Ministry to provide other or additional grants now or in the future. Article 9 Renorts 9.1 The Grantee shall prepare and deliver in fonn and content satisf1 tory to the Ministry all such reports, including the reports set out in Schedule A - TERMS 0 REFERENCE 2005/2006 RIDE GRANT PROGRAM, as the Ministry may require. Any rts the Grantee is required to submit shall be complete and accurate and shall be submitted to e Ministry within the time frames specified by the Ministry. 9.2 The Grantee shall provide reports on financial status and relevant financial and program evaluation based on project infonnation as stipulated in Section 1 .1 of the Agreement. Page 3 .. 10.3 The Grantee shall indemnify the Ministry and its employees and gents, against all costs, losses, expenses or liabilities incurred as a result of a claim or proceedin related to this Agreement. 10.4 The Grantee shall maintain, at its expense, comprehensive gen liability insurance of at least Five Million Dollars ($5,000,000.00) per occurrence. At the req est of the Ministry, the Grantee shall provide satisfactory proof of such insurance. Article 11 Assil!Dment 11.1 The Grantee will not assign this Agreement, or any part of it, wi out the prior written approval of the Ministry, which approval may be withheld by the Ministry in ts sole discretion or given subject to such terms and conditions as the Ministry may consid necessary. Article 12 Freedom of Inti rmation and Protection of Priva L 12.1 Any information collected by the Ministry pursuant to this A ent is subject to the rights and safeguards provided for in the Freedom of Information and Prote lion of Privacy Act. The Grantee acknowledges and agrees that any information provided the Ministry may be disclosed pursuant to the Freedom of Information and Protection of Priva Act, Article 13 Publicitv 13.1 The Grantee will acknowledge the Ministry and the Grant in all p blic communications relating to the Project or this Agreement including, but not limited to, P releases, published reports, radio and television programs and public meetings, using the foil . g standard acknowledgement: "This Project has been made possible by a gr t from the Ministry of Community Safety and Correctional Services. " 13.2 The Grantee agrees to obtain prior written approval fÌ'Om the .. try before using any Government of Ontario or Ministry logo or symbol in any comm . cations including press releases, published reports, television programs, public or private eetings, or in any other type of promotional material, relating to the Project or this Agreement. Article 14 Notices 14.1 Notices under this Agreement shall be in writing and sent by p transmission ("Fax") or by ordinary prepaid mail. business day after the date of 14.2 Notices by mail shall be deemed to have been received on the fo mailing. MAXIMUM FUNDING APPROVED The grant provided by the Ministry of Community Safety and Correction I Services is in the amount of $5349.58, which will be on a one-time basis for that period from April 1, 2005 to February 28, 2006 to assist with costs of staff overtime, or paid duty. The total grant allocati must be used onlv for staff overtime or paid duty. 2. R LOCATION OF UNUSED FUN -INTERIM FINANCIAL STA The Grantee shall review its Grant expenditure to December 31, 2005 nd shall notify the Ministry by January 5,2006 on a form attached as Schedule B - 2005l20061NTE M FINANCIAL STATUS REPORT to the Agreement, of its to-date expenditure and the amount, any, which will not be used by the end of this fiscal year. This amount will be reallocated to other Poli Services, which have requested additional funding. 3. ACCOUNTING INFORMATION The Grantee shall provide such financial information as may be requi time. In addition, the Grantee shall by March 6, 2006 provide the Mini of all expenses with respect to which Grant monies have been expend by the Ministry from time to with an accounting, in detail, 4. STAFF OVERTIME AND PAID DUTY BILLING Staff costs are overtime or paid duty for street level enforcement activiti in relation to the program for which the Grant is provided. Staff will not include civilian or auxiliary 0 cers. For the Grant to reflect the amount of staff overtime or paid duty, a one-time final billing will be ubmitted on Schedule C- 2005 /2006 FINAL REPORT ON RIDE GRANT PROGRAM of the Ag ment to the Ministry by March 6, 2006. This billing must be certified by a Municipal Clerk Treasurer 0 a senior representative of the Grantee's financial services who can verify the accuracy of the claim. he billing will itemize dates worked, name and rank of officers, rate of pay (basic hourly rate), num r of overtime/paid duty hours worked, number of hours paid and total hours used by the service for t period of April 1, 2005 to February 28, 2006 5.
