RESTRICTING THE WEIGHT OF VEHICLES PASSIN
OVER A BRIDGE
WHEREAS subsection g o£ section 52 of The Hig ay Tra££ic Act
(R.S.O. 1960, chapter l72) provides that:-
The Municipal Corporation or ether autho ity having
jurisdiction over a bridge may by By-la approved by the
Department make regulations limiting th gross weight of any
vehicle or combination o£ vehicles or a y class thereof
passing over such bridge and notice of he limit o£ the weight
£ixed by such regulations, legibly prin ed, shall be posted
up in a conspicuous place at each end 0 the bridge.

NOW THEREFORE the Council of the Corporation
o£ the Town of Kincardine enacts as follows:-

1. No vehicle or combination of vehicles or a y class thereof,
whether empty or loaded, shall be operated ov r the bridge
known as Queen Street Bridge at the Penetango e River in the
Municipality of the Town of Kincardine with a weight in excess
of 30,000 pounds.
2. Any person violating any of the provisions
shall be subject to the penalties provided in
section 52 of the Highway Traffic Act.
3. This by-law shall net become effective unti

Further to our letter dated July 15th, ~nc1osed is
approved copy of By-law No. 2127.
You will note the by-law has been approyed for a
period of two years, this limitation being the reþommendation
of the Bridge Office.
The writer would also point out with re~pect to the
penalty provided in section 2 of the by-law that ~ubsection 7
of section 52 of The Highway Traffic Act was receÞ.t1y amended
to preclude penalties for violation of a by-law o~ this nature.

The general penalty as prescribed in section 154 þf The Highway
Traffic Act now applies. '
