HomeMy WebLinkAboutKIN 70 2132 Regulation of traff .~~~. ,~ · THE CORPORATION OF THE TOWN OF KIN CARD E BY-LAW NUMBER 2132 FOR THE ROOULATION OF TRAFFIC (1) ~6-~ fpP~~ " - The Council of the Corporation of the Munici lity 01' Kincardine enacts as follows: PART 1 DEFINITIONS For the purpose of this by-law:- (a) Commercial motor vehicle means any mot r vehicle having permanently attached thereto a' ruck or' . delivery body' and includes ambulances, hearses, casket wagons, fire apparatus, police troIs, motor buses and tractors used for haul ng purposes on the highways. Corner means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic. (e) Highway includes a common and public h ghway, street; avenue, parkway, driveway, sq re, place, bridge, viaduct· or trestle, designed a d intended for, or used by, the general public fo the . passage of vehicles. (f) Intersection means the area embraCkld w thin the · îrolongation or connection of the late I curb ines or, if none, then of the lateral boundary lines of two or more highways that joi one another at an angle, whether or not one highwa crosses the other. (g) One-way street means a street upon whi h vehi cular traffic is limited to movement in one irection. (h) Park or ?irking when prohibited, mea'l the standing of a veh1cle, whether occupied or not, except when standing temporarily for the purpose 0 and while actually engaged in loading or unloadi merchandise or passengers. (i) Pedestrian means a person afoot and an inva lid or child in a wheelchair or carriage. Police officer means a member of hhe lice force or a person authorized by the Chief Co stable to regulate or direct traffic. . (b) · . (0) Crosswalk means that part of a highway at an intersection that is included within t e connect- ions of the lateral lines of the sidew lks on opposite'sides of the highway measured from the ourbs or, in the absence of curbs, fro the edges of the roadway; or any portion of a r adway at an intersectbn or elsewhere distinctly in icated \ for pedestrian crossing by signs or by lines or other markings on the surface. OBEDIENCE TO TRAFFIC ROOULATIONS Police to enforce By-law The police department shall enforce the provisions of this by-law. 2. Obedience to traffic signs and signals I. Every person shall promptly obey all si nals given either by a police officer or by traffic control device or a traffic sig al. 3. ONTARIO HIGHWAY TRAFFIC ACT TO VOVERN The provisions of this by-law shall be to the provisions of the Highway traffi (R.S.O. 1960, Chapter 172) and amendmen thereto. ubject Act s PART 111 PARKING I. Method of parking a. Parallel No person shall park a vehicle on any street other than a one-way street unle s on the right hand side of the street, having regard for the direction in whic the vehicle had been proceeding and unless the right front and right rear wheels or runners are parallel to and distant respectively not mo~ than six inches from the edge of the roadway. b. Anp;le Where angle parking is permitted, no person shall park a vehicle except at a angle of forty-five degrees with the ed e of the roadway and so that the front en of the vehicle is nearest to the edge 0 tœ roadway. c. OPERATION OF VEHICLES 6. Nothwithstanding anything to the cont ary contained herein, the Chief of Police, during a y emergency or special circumstances deemed sufficie t therefore may by the use of appropriate signs or si nals susspend the movement of any or all vehicular traf ic or any street or portion thereof and or may suspend ny or all parking regulations and parking thereon and t e Chief of Police during <.uch emergency may declare tha any vehicle alrea- dy parked is being parked illegally r ardless of the time permitted for parking such vehic under the provisions of this by-law and notwith nding that the period allowed to the owner or dr er under this by··law has not expired; provided howe er, that in this event the owner or driver of such veh cle is personally notify by a police officer that parki at such place has been suspended, and further that the 0 ner or driver of such vehicle is allowed a reasonable riod of time to remove period of time to remove said ehicle. 12. 2.In addition to the penalties provided of Po~ice or any other authorized Poli order the removal of any unlawfully pa a suitable place of storage and all co for the renewal, care and storage ther lien on such vehicle.
