THE CORPORATION OF THE TOWN OF KINCA
BY--LAW NO.2l29
BEING A BY-LAW PROVIDING FOR THE CONTROL, LICENSI G
OF DOGS WITHIN THE TOWN OF KINCARDINE.
WHEREAS IT IS PROVIDED by Section 5 of THE DOG TAX and LIVE STOCK
and POULTRY-PROTECTION ACT, Revised Statutes of 0 tario 1960,
Chapter 111, as amended that Councils of Municipa ities !!lay pass
by-laws for licensing and regulating the registra ion of dogs for
imposing a license fee on the owners of them.
THEREFORE the Council of the Corporation of th Town of Kincardine
enacts as follows:
PARTl
(a) That By·-Law Number 1892 of the Town of Kin ardine be and the
same is hereby re~ealed.
PART 11
(a) "Dog" shall mean either male, female, or s yed female dog.
(b) "Owner" shall include possessor or harbour r; and
"Owned" shall include possessed or harbour d.
(c)
"Ticket V shall moon a serially numbered no ice in triplicate
stating:
(1) Nature of alleged offence.
(2) Date and time of alleged offen e.
(3) Dog Tag number.
(4) Name and address of owner.
(5) Penalty for alleged offence if paid within
prescribed time.
(6) Time during which penalty may e paid out
of Court.
(7) The ticket shall be signed by he Canine Control
officer issuing the ticket or ther person
authorized by the Council of t e Municipality
(d) "Canine Control Officer" shall mean the p rson designated by
the Municipal Council of the Corporation f the Town of
Kincardine to enforce this by-law.
PART 111
LICENSING AND RIDISTRATION OF DOGS
L. Every owner or harbourer of a dog in the Town f Kincardine shall,
within one week after the dog comes into his poss ssion cause such
a dog to be licensed and registered in the office of the Clerk of the
Municipality for the period which will expire on the last day of
December and shall thereafter annually on or befo e the fifteenth
day of February in each year cause such dog to be again licensed
and registered for One year from the first day 0 January

fee applicable thereto, which is hereby imposed pon such owner as
follows:

Provided that where the owner acquired the dog a ter expiration of
6 months of the year he shall be charged with on y one-half of the
. dog tax. Provided further that any owner who had prior to the passing
~ of this by-law caused to be licensed for 1970 un er by-law 1992 a dog
or dogs in his possession at the date of the pas ing of this by-law,
shall be deemed to have caused the said dog or ogs to be licensed
for the purpose of this by law for the year 197 .
2. Any owner not procuring a license for his do on or before the

6. Any person who contravenes the provisions of paragraphs one
and two is liable to a fine of not less than $5. 0, and not more
than $10.00 (exclusive of costs)for each contrav ntion, and any
person who contravenes the provisions of paragra h 4 (d) is liable
to a fine of not less than $10.00 and not more t n $20.00 for each
contravention; every such penalty shall be recov rable under the
Summary Convictions Act, all provisions of which shall apply except
that imprisonment may not exceed twenty-one (21) days for each

PART IV
RUNNING AT LARGE OF DOGS
1. For the purpose of this part a dog shall be deemed to be running
at large when in a highway, or any publi~ pl~ce, and not under the
control of any person.

4 (a) If the owner of an impounded dog can be ide tified said owner

the last known place of residence of said owner. f the dog is not
claimed within three (3) days and said dog is des royed then the
owner shall bear the cost of destruction.
(b) In addition to penalties provided for in th s by-law, the
procedure of the Summary Convictions Act shall ap ly and the follo-
