AUTHORIff: The Cemeteries Act R-5,'-O- 1970 Chapter 57 Sec. 69 Being a By-law to operate, *aintainj regulate and control the management of the Kincardine Cemetery, located in the Tarn of Kincardine, The Council of the Town of Kincardine enacts as follows: 1. THAT Lots shall be disposed of as marked and designated upon the plans of the said cemetery$ formerly adopted and hereby confixmed and that no, lots shall be chosen from grounds reserved for roadways for vehicular traffic. 2. THAT the caretaker on approval of the Cemetery Commission, shall prohibit the entry of vehicles on the Cemetery Grourxis, when grounds are not in a condition to be driven upon. 3. THAT when a lot is required application to be made to 'MWN Clerk or Secretary of the Board, and wheAhoxen and paid for,, a deed shall be made out by the Town Clerk and the Mayor shall "execute the same and affix thereto the Corporate Seal of the said Town of Kincardine. t . THAT proprietors of lots shall be at liberty to dispose of their rights and to have tIae transfer duly registered in the Secretaryfs records, for the fee of $2.00 with deed$ but no proprietor shall allow interments to be made therein for remuneration. 5. THAT no proprietor be allowed to enclose his lot with a hedge or coping,$, nor any shrubbery as a hindrance to the proper care of any lot. That if any trees, shrubs situated on any lot shall, by means of their roots, branches or otherwise, become detrimental to the adjacent lots or paths, or dangerous or inconvenient to pedestrians2 or detrimental to the cutting of grass$ the Cemetery Commission have the right to enter on the said lot and have same removed if deemed advisable. 6. THAT the proprietor of a lot shall be permitted to erect any proper stone or monument, in conformity with other monuments, and all markers shall be placed level with the fro und. 7. THAT all monuments shall be set on a cement foundation five feet deep and the full width of the base of the monument and the caretaker shall be responsible for the carrying out of these regulations and to immediately notify the Gemetery Commission when these instructions are not carried out. Foundations cost shall be paid for before the erection of a monument, 8, THAT the proprietor of lots and their families - but no children shall be admitted to the Cemetery, unless with their parents or with persons having charge of them - shall have free access to the grounds at all times from sunrise to sunset., provided they observe all the rules of this By-law, 9. THAT all workmen, employed in constructing vaults and erecting monuments, shall be subject to the control and direction of the Commission, as to their location, and as to removing rubbish as may be directed. 10, THAT the interments, of the poor a� all persons unable to pay the necessary expenes, shall be in such portions of the ground as may from time to time be designated, by the Cemetery Commission for that purpose. 11. THAT wherever interments are to be made, notice must be given (except in special cases) to the caretaker forty eight hours previous to the interment, the name of the deceased to be interred, the size and type of construction of the outer shell and the locations of the grave. 12. THAT no person having refreshment of any kind shall be permitted to come within the grounds or cemetery. 13. THAT no person shall be allowed to pick any wild or cultivated flower, shrub or plant growing in the said cemetery, . 1, '4 ' 14. THAT no person shall bring any dog,, goat, or cattle within the limits of the cemetery upon any pretense whatsoever, and any person infringing on this proviso shall be compelled to leave the grounds forthwith, and in case of refusal shall be subject to the penalty herein provided. to 15. No person shall, (a) Wilfully, destroy, mutilate, deface, injure or remove any tomb, monument, gravestone of other structure placed in a cemetery, or any fence, railing or, other work for the protection or ornament of a cemetery, or of any such tomb, monument, gravestone or other structure or of any lot in a cemetery. (b) Wilfully destroy, ctit, break or injure any tree, shrub or plant in a cemetery, or wilfully injure, destroy or deface any building or structure or any road, walk or other works in a cemetery. (c) Play at any game or sport in a cemetery. (d) Discharge firearms in a cemetery, except at a military funeral. (e) Wilfully and unlawfully disturb persons assembled for the purpose of burying a body in a cemetery; or (f) Commit a nuisance in a cemetery. 16. THAT the money created by the Perpetual Care Charges, and all money derived, shall be in a special fund deposited in a Chartered Bank, subject to withdrawl by the signature of the Chairman and the Treasurer of the Municipality. And shall be invested, from time to time in accordance with the Trustee Act R.S.O. 1970 Chapter 47 and be sanctioned by the majority of the Cemetery Board. 17. THAT the said Cemetery Commission shall hold meetings from time to time and other special meetings, if necessary, at the call of the Chairman or three Members of the Board. 18. Any person violating any of the Provisions of this By- law shall be subject to a penalty of not more than forty dollars ($1+0.00) exclusive of costs and all such penalties shall be recoverable under the Ontario Summary Convictions Act. 19. THAT all cheques shall be signed by the Treasurer, and countersigned by the Chairman of the Commission. 20. The charges for burial lots in the Kincardine Cemetery and other services and matters referred to in Schedule "All to this By-law shall be as respectively set out in the said Schedule. 21. This By-law shall take effect upon the final passing thereof and upon receiving the approval of the Ministry of COnsumer & Commercial Relationst Cemeteries Branch for the Province of Ontario. 22. By-laws 830 and 842 and 843 of the Town of Kincardine be and the same are hereby repealed. Read a first time Read a second time Read a third time and finally passed this Ath day of May 1972. The Council of the Corporation of the Town of Ki cardine ENACTS as follows: That By-law No. 2238 as amended by By-law No. 30 4, 3138 and 3175 of the Corporation of the Town of Kincardine, be ng a By-law to operate. maintain, regulate and control the mana ement of the Kincardine Cemetery, be and the same is hereby ended by the addition of a revised Schedule "A" as follows: 1.
